Vidyard Privacy Policy

Buildscale, Inc., d/b/a Vidyard, and our subsidiaries and affiliates (collectively, “Vidyard,” “we” or “us”) provide a business video platform service that helps businesses transform communications and sales through the use of online video. In this Vidyard Privacy Policy (this “Policy”), we explain how Vidyard collects, uses, discloses and otherwise processes the personal information described in this Policy, as well as the rights and choices individuals have regarding such personal information. Vidyard has customers in many jurisdictions, all with varying privacy laws and requirements. While we strive to take a consistent approach to privacy compliance across jurisdictions where possible, some terms, obligations, and rights may only apply or be available in, or may vary in, certain jurisdictions.

CALIFORNIA PRIVACY RIGHTS: If you are California resident, please see our California Privacy Notice below for information about the categories of personal information we collect and your rights under California privacy laws, including the right to opt out of “sales” and “sharing” under the California Consumer Privacy Act (the “CCPA”).

About Vidyard and this Policy

Vidyard’s platform and services are designed to help sellers and other businesses. In the course of providing our platform and services to business customers and conducting and managing our business and operations, we may collect and process personal information about customers, partners, applicants, vendors, and others who interact with us or our services. This Policy applies to the extent we process personal information on our own behalf, as a data controller. It does not apply to the personal information we process as a data processor, on behalf of our customers.

Vidyard’s customers may also collect, disclose, and otherwise process personal information about viewers of their content and others with whom they interact through our platform and services, or direct us to do on their behalf (as their data processor). Our customers are responsible for the personal information processed by or on their behalf through our platform and services—their processing activities are subject to their respective policies and practices, and not this Policy.

Your use of the Vidyard Websites and other Services is subject to the practices outlined in this Privacy Policy, as well as our Self-Serve Terms of Service (if applicable to you) and our Acceptable Use Policy . If you do not agree with our practices set forth in this Policy, you should not interact with or use any of our websites or services or otherwise provide Vidyard with your personal information. Where Canadian law applies, by using our Websites and Services you are acknowledging and consenting to the collection and use of your personal information as described herein.

Scope

This Privacy Policy applies to the personal information we collect, as a data controller, related to:

  • Our websites where this Policy is posted, including www.vidyard.com , http://secure.vidyard.com and their respective subdomains (collectively, our “Websites” and each a “Website”).

  • Users of our Websites and the Vidyard platform and related services, including the Vidyard mobile applications, desktop applications, and software (“Apps”) that Vidyard provides to enable access to and use of the services, and any other services provided by Vidyard through our Websites and Apps (collectively the “Services”).

  • Content and information (including any personal information) uploaded, created, distributed, and managed by our customers through the Services.

  • Communications and interactions with us online, offline and otherwise, including on the telephone, via chat, in person, and through other means.

  • Webinars, events (online and offline), and promotions (such as contests, sweepstakes and other promotions we sponsor) that we sponsor, and surveys and market research we conduct.

  • Our advertising and marketing campaigns and activities.

  • Current, former and prospective customers, vendors and partners.

  • Applicants and candidates for a position with Vidyard.

Out of Scope. This Privacy Policy does not apply to the personal information that Vidyard processes as a data processor, on behalf of its customers, nor does it apply to the practices of our customers and other third parties that use the Services to distribute or show you videos or other content via our Services. You should review the privacy policies of those third parties for information on how they use your personal information.

In addition, this Privacy Policy does not apply to the personal information that we collect about employees and personnel.

Personal Information Collected

As further described below, we collect personal information directly from individuals, as well as from third parties. In addition, we automatically collect or derive information related to the use of our Websites and other Services or interactions with us. The personal information we collect depends upon how you use our Services or otherwise interact or engage with us or our Services.

Personal information we collect directly. While the personal information we collect about individuals varies depending upon the circumstances, it generally includes:

  • Registration and contact information, including name, mailing address, telephone number, and email address.

  • Financial information, including credit card number, security code, billing address, authentication and security information and other billing data.

  • Business information, including business name, title, employee information, business contact information and location.

  • Images and videos, such as the images and video content you upload through our Services.

  • Job application information, including name, address, employment history, education background, interests and other information included in cover letters, resumes and job applications.

  • Visitor information, including name, organization information and photo for identification purposes.

  • Communication information, such as the content of your inquiries, complaints and feedback directed to our team.

  • Custom avatars you create using the Services, including training videos, and related information. If you create a customer avatar, you must consent to the collection and processing of your biometric data, which may be generated and derived from your training videos and content, to create your custom avatars. Please see our Biometric Information Notice and Policy for more information.

Personal information we automatically collect or derive about you. We collect or derive information related to the use of our Services and how you interact with us and our Services, including information we collect automatically (e.g., using cookies and pixel tags), as well as information we derive about you and your use of the Services. Such information includes:

  • Device and browsing information: We use cookies, log files, pixel tags and other tracking technologies to automatically collect information when users access or use our Services, such as IP address, general location information, domain name, page views, a date/time stamp, browser type, device type, device ID, Internet service provider, referring and exiting URLs, operating system, language, clickstream data, and similar device and usage information. For more information, see the “Cookies, Analytics and Targeting” section below for more details.

  • Activities and usage: We also collect activity information related to your use of our Websites and Services, such as information about the links clicked, searches, features used, items viewed, time spent within the Services, and videos and content uploaded and shared.

  • Location information: We may collect or derive location information about you (e.g., through your IP address). Further, with your permission, we may collect geolocation information from your device. You may turn off location data sharing through your device settings.

  • Technical Data and Metadata: We also collect or receive ‘metadata’ about content posted, shared, created and distributed using our Services, such as date and time stamps, location, device type.

Personal information we collect from other sources. We may also collect personal information about you from third party sources, such as public databases, joint marketing partners, social media platforms or other third parties, including:

  • Public sources: We may receive lead and prospect information from third parties, about prospective customers that may be interested in our Services. We may also use publicly available information in online directories or social media, for example your business contact information may be enriched with data from LinkedIn, or engage with third parties to help us enhance or update our customer information.

  • Social media: If you post information about us or engage with us on third party platforms or choose to link your Vidyard account to or log in to our Services with a third-party account (e.g., Google), we may collect personal information about you from that third party platform or account. These third-party platforms and services control the information they collect and share about you. For information about how they may use and disclose your information, including any information you make public, please consult their respective privacy policies.

  • Third-party integrations: Customers may be able to connect or integrate third party platforms with the Services. If you grant us permission to access this data by enabling such integrations, we may receive certain information from and about your account with these third-party platforms (See the “Customer Sharing and Integrations” section below for more information).

CALIFORNIA RESIDENTS: please see our California Privacy Notice, at the end of this Policy, for additional information about the categories of personal information we collect about you, pursuant to the CCPA.

Aggregate and Non-identifiable Data

We may also collect or compile aggregate, anonymous, and other non-identifiable data related to our business and the Services, which we may use and disclose for quality control, analytics, research, development and other purposes. Where we use, disclose or process de-identified data (data that is no longer reasonably linked or linkable to an identified or identifiable natural person, household, or personal or household device) we will maintain and use the information in deidentified form and not attempt to reidentify the information, except in order to determine whether our deidentification processes are reasonable and adequate pursuant to applicable privacy laws.

Purposes of Collection and Processing of Personal Information

In this section, we describe the business and commercial purposes for which we collect, use, disclose and otherwise process personal information, as well as the legal basis for our processing pursuant to the GDPR and similar data protection laws. Keep in mind that our processing of personal information, as well as the applicable legal bases for doing so, varies depending upon the circumstances and your interactions with us.

Purposes of Collection, Use, Disclosure and Processing. While our collection, use, disclose and other processing of your personal information will vary depending upon the circumstances (such as your relationship or interactions with Vidyard), in general we may process personal information for the following purposes (and where required by applicable privacy law, we will obtain your consent to certain types of processing):

  • Services and support: To provide and operate our Services, communicate with you about your use of the Services, provide troubleshooting and technical support, respond to your inquiries, requests or applications, fulfill your orders and requests, process your payments, communicate with you about the Services, and for similar service and support purposes.

  • Analytics and improvement: To better understand how users access and use our Websites and other Services, and our other products and offerings, and for other research and analytical purposes, such as to evaluate and improve our services and business operations, to develop services and features, and for internal quality control and training purposes. We may also use content and personal information to test, train and improve AI technologies and models.

  • Customization and personalization: To tailor content we may send or display on the Services, including to offer location customization and personalized help and instructions, and to otherwise personalize your experiences.

  • Marketing and advertising: For marketing and advertising purposes. For example, to send you information about our Services, such as offers, promotions, newsletters and other marketing content, including about third party products and services we think may interest you, as well as any other information that you sign up to receive. We also may use certain information we collect to manage and improve our advertising campaigns so that we can better reach people with relevant content. Where required by applicable law, we will obtain your consent to process your personal information for these purposes.

  • Planning and managing events: For event planning and management, including registration, attendance, connecting you with other event attendees, and contacting you about relevant events and Services.

  • Research and surveys: To administer surveys and questionnaires, such as for market research or customer satisfaction purposes.

  • Security and protection of rights: To protect the Services and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of any person or third party, or violations of any applicable terms and conditions that we issue.

  • Compliance and legal process: To comply with the law and our legal obligations, to respond to legal process and related to legal proceedings.

  • General business and operational support: To consider and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions, and related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions.

Legal bases for processing personal information. Certain laws, including the GDPR, UK and Brazilian data protection law, and similar laws, require that we inform you of the legal bases for our processing of your personal information. Pursuant to these laws, we generally process personal information for legal bases described below.

Your consent. We may process your personal information, on the basis of your explicit consent, including for example:

  • To review and process job applications.

  • Where you authorize us to share or license your content and personal information to third parties.

  • Where we obtain your consent (to the extent required by applicable law) to send you marketing and targeted advertising.

  • For the performance of a contract or agreement: We may process your personal information where necessary to enter into, carry out, or perform our legal agreements with you. This includes, for example:

    • Processing your purchases, including keeping track of transactions and reporting back to you.

    • Providing information or services requested by you.

    • Permitting you to send invitations to other individuals to use our Services.

    • Assisting in optimizing the delivery of your content to viewers.

    • E-mail gating of content.

    • Delivery of content and information to third party services and partners.


Our legitimate interests: We may also process personal information in furtherance of our legitimate business interests, when these interests are not overridden by your privacy interests and fundamental rights, including:

  • Communicating with you in accordance with applicable law.

  • Administering and managing the Websites and our business operations.

  • Preventing, detecting, investigating and responding to actual or potential security incidents or threats.

  • Protecting against fraud or error.

  • Evaluating statistics on Websites activity.

  • Performing statistical analyses of your behavior and characteristics, in order to measure interest in and use of the various sections of the Websites.

  • Assisting in diagnosing problems with our Services and Apps.

  • Fulfilling any other purpose that would be reasonably apparent to the average person at the time that we collect it.

Compliance with a legal obligation. We may also process personal information where doing so is required for compliance with laws and legal obligations to which we are subject, such as:

  • Responding to binding law enforcement and regulatory requests and inquiries.

  • Complying with accounting, recordkeeping, audit and other obligations under applicable laws and regulations.

Other legal bases. We may also process personal information where necessary to protect or defend our legal rights, and respond to legal claims, or where doing so is necessary to protect the health, safety or vital interests of any individual.

Disclosures of Personal Information

Vidyard discloses content and personal information, as directed or authorized by our customers. For example, some of the Services enable customers to upload, manage and publish content to their own websites or to third party websites and platforms, to invite others to view their content, and to otherwise communicate or interact using the Services. In addition, customer can consent to or authorize sharing and licensing of their content as part of certain features of the Services we offer.

In addition, Vidyard may disclose or make available personal information, including content, to:

  • Service providers. Vidyard uses third parties to assist us in administering and providing the Websites and Services or to provide other services on our behalf. Examples include managing content, analyzing data, providing marketing assistance, integrations of third-party services such as CRM and MAP services, processing credit card payments and providing customer service.

  • Vidyard Customers. We may provide customers with certain identifiable usage information related to the videos and other content that they make available through the Services. This includes information about who viewed the content and how many times a particular video was watched by a particular viewer. Customers may also integrate or connect third party platforms and accounts with their Vidyard account. (For more info on this, see the “Customer Sharing and Integrations” section below). Vidyard is not responsible for the collection, sharing or processing of personal information by our customers using the Services; their practices are subject to their own policies and practices, and not this Policy.

  • Third-party platforms, providers and networks. We may disclose or make available personal information to third party platforms and providers that we use to provide or make available certain features or portions of the Services, or as necessary to respond to your requests.

  • Marketing and advertising companies. We may also make certain information that includes personal information available to third parties in support of our marketing, analytics, advertising and campaign management (see the “Cookies, Analytics and Targeting” section below, for more information).

  • Enterprise and workspace users. If you create an account using a company email address, we may share that you are a Vidyard user with other individuals using the Services that have the same company email domain. If you have an enterprise account, we may also share your account information and content with that enterprise and its administrators. If you choose to be part of a shared workspace or business account (either by joining a workspace or accepting an invitation from your organization), certain information about you, including your name, profile picture and statistics relating to your usage of the Services will be accessible by other users within the shared workspace.

  • Partners. We may disclose and license videos and content (which includes personal information) created and distributed by customers through the Services to third parties who may use it for purposes of training, testing, and improving AI technologies and models, subject to and as permitted by the Self-Serve Terms. Where required by law, we will obtain your prior consent to do so. You can opt out or withdraw your consent (as applicable) at any time, as set forth in the “Privacy Rights and Choices” section below.

We may also disclose personal information to others under the following circumstances:

  • Legal requests. Vidyard may disclose personal information when required by law to respond to subpoenas, court orders or other legal process by authorities with jurisdiction.

  • Enforcement. Vidyard may disclose personal information in order to establish or exercise our legal rights, or to defend against legal claims, or when we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, data breaches, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.

  • Business transactions. If we or our affiliates are or may be acquired by, merged with, or invested in by another company, or if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected from you to the other company. We may also share certain personal information as necessary prior to the completion of such a transfer, such as to lenders, auditors, and third-party advisors, including attorneys and consultants, as part of due diligence or as necessary to plan for the transfer.

Cookies, Analytics, and Targeting

Vidyard and our third-party service providers use cookies, etags, pixels/web beacons, APIs and other similar technologies to automatically collect, record and share certain data about you and your online activities, when you visit our Websites or interact with our Services. The data collected may include, for example, your IP address and other online identifiers, browser and device info (e.g., browser/device type, operating system and version), referring URLs, online interactions and communications, interactions with the Vidyard Services), and other usage and activity data on our Websites and within our Services.

Some of these technologies are ‘necessary’ for our Services to function properly (e.g., to secure, protect, and optimize the performance of our Websites and other Services). Others may be used to enable third party features and functionality (e.g., social media and chat), analyze traffic and usage, record user sessions, detect and remember user settings, personalize experiences, measure and target content and ads (including on third party sites and services), or identify and resolve bugs and errors. You have certain choices about our use of cookies and tracking, as described in this section.

Cookies. Cookies are alphanumeric identifiers that we transfer to your device’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Services, while others are used to enable a faster log-in process, support the security and performance of the Services, or allow us to track activity and usage data within Service.

Pixel tags. Pixels (sometime called web beacons, tags or clear GIFs) are tiny graphics with a unique identifier, similar in function to cookies. While cookies are stored locally on your device, pixel tags are embedded invisibly within web pages and online content. We may use these, in connection with our Services to, among other things, track the activities of users, help us manage content and compile usage statistics. We may also use these in HTML e-mails we send, to help us track e-mail response rates, identify when our e-mails are viewed, and track whether our e-mails are forwarded.

Third-party analytics and tools. We use third party tools on our Websites and in our Services, such as Google Analytics. These third-party companies may collect usage data (using cookies, pixels and similar tools) about our Services in order to provide us with reports and metrics that help us to evaluate usage of our Services and improve performance and user experiences. You can download the Google Analytics Opt-out Browser Add-on to prevent their data from being used by Google Analytics at https://tools.google.com/dlpage/gaoptout .

Cross-device tracking. We and our third-party providers may use the information that we collect about you within our Services and on other third-party sites and services to help us and these third parties to identify other devices that you use (e.g., a mobile phone, tablet, other computer, etc.).

Targeted advertising. We work with third party ad networks, channel partners, analytics and measurement services, and others (“third-party ad companies”) to provide personalized content and for targeted advertising purposes. We may provide or make available certain usage and browser data to these third-party ad companies, which they may combine with usage and browsing information collected from third-party sites, apps and sources. This information is used to provide you more relevant ads and content across third party sites and services, and to evaluate the success of such ads and content.

Custom lists and matching. We may create and share certain customer list information about our customers and prospective customers (such as email address and contact information), so that we can (i) better target ads and content to customers and prospective customers across third party sites, platforms and services, and (ii) in some cases, these third parties may help us to enhance our customer lists with additional demographic or other information, so we can better target our advertising and marketing campaigns (“Custom List Campaigns”). You can opt out of Custom List Campaigns, as set forth below, in the “Privacy Rights and Choices” section.

Managing your preferences. We make available several ways for you to manage your preferences regarding targeted advertising, matching and cookies on our Websites. Many of these are browser and device specific, which means that you need to set the preference for each browser and device you use to access our Services; in addition, if you delete or block cookies, you may need to reapply these preferences. Further, opting out of cookies and advertising as discussed below does not mean that you will no longer receive advertising content from us. You may continue to receive generic or “contextual” ads from us.

  • Cookie preference manager: You can review or change your preferences for targeting cookies and tags on our Websites through the cookie banner that appears on our Websites, where applicable to you.

  • Browser signals. Our websites do not currently recognize or respond to browser-based Global Privacy Control (GPC) or “do not track” signals.

  • Industry ad choice programs. You can also control how participating third-party ad companies use the information that they collect about your visits to our Websites to display targeted advertising to you. See the links below for more information.

    • EU: youronlinechoices.eu (European Interactive Digital Advertising Alliance)

    • U.S.: aboutads.info/choices (Digital Advertising Alliance). You may also download the DAA AppChoices (https://youradchoices.com/appchoices) tool in order to help control interest-based advertising on apps on your mobile device).

Customer Sharing and Integrations

As further described in this section, in using the Services, Customers may:

  • Post, publish and share videos and content from their Vidyard account to other websites and platforms

  • Collect and share additional personal information about viewers

  • Provide us with contact data so that they can invite and connect with others through the Services

  • Link social media and other third-party accounts with their Vidyard account

  • Integrate their Vidyard account with third-party platforms

Customers are responsible to obtaining all necessary permissions to collect and share personal information (including contact data) with Vidyard and others through the Services. Vidyard is not responsible for the collection, use and sharing of personal information by customers or their third-party integrations and services.

Connecting third-party accounts. Customers may link certain social media accounts (such as Google+ or YouTube) with their Vidyard account, and grant us permission to access/receive certain information from these accounts. The precise information varies but may include your profile name or user ID, contact information, and other information you agree to share when you connect your third-party account. You can unlink your social media account through your Vidyard account—after logging in to your Vidyard account, select “Groups” > click “Integrations” > and click “Remove” next to any social media account you would like to unlink.

  • Google API services: Certain Services enable customers to access the contact data in their Google Workspace account. If you give the Services access to this contact data, Vidyard will use it to identify email addresses that contain the same domain name as the email address you used to register for the Services, so that you can choose to invite these contacts to join you in the Services. Our use and transfer of this contact data from Google APIs to any other application will adhere to the Google API Services User Data Policy , including the Limited Use Requirements. We do not share your data with third party applications, including AI models.

  • YouTube API services: Customers may choose to connect their YouTube account with their Vidyard account, in which case we collect certain information from your YouTube account, including the name associated with your account and certain viewing information (e.g., viewing counts) about the videos on your YouTube channel that are associated with your Vidyard account. You can also limit or revoke access to your YouTube data from your Vidyard account (as explained above) or via the Google security settings page at https://security.google.com/settings/security/permissions .

Shared content. When customers share, post or publish videos and content on third party sites and platforms using the Services (e.g., by embedding our video player), Vidyard collects and processes information about that customer’s account and viewing and use of their videos and content on these third-party sites and platforms.

In addition, as noted above, customers may also use the Services and other third party tools to collect additional personal information about the viewers of their videos, including contact information such as name, title, email address, physical address, phone number, etc., and information about a viewer’s computer or mobile device or technology usage, including (for example) IP address, MAC address, unique device identifiers, unique identifiers set in cookies, and any information passively captured about a person’s online activities, browsing, application or hotspot usage or device location.

Third-party Links and Buttons

The Websites and Services may also contain links to third party websites or services. These links are intended for your convenience only. These websites and services are wholly independent from Vidyard and have separate privacy policies and data collection practices, independent of Vidyard. We have no responsibility or liability for these websites, their policies or their privacy practices. We encourage you to read the privacy policy of any websites you visit.

Children and Minors

Protecting the safety of children when they use the Internet is very important to us. The Websites and Services are not designed or intended for use by minors. Vidyard does not knowingly collect the information of minors. Please contact us at privacy@vidyard.com for any concerns or questions about children’s personal information.

International Data Transfers

Vidyard is headquartered in Canada, and the Services are hosted in the United States. Some or all of the personal information we collect may be stored or processed on servers located in Canada and the United States, and in other jurisdictions in which our service providers have operations. As such, we and our service providers may transfer your personal information to, or process it from, outside the country in which you reside, and your personal information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions. The data privacy laws may not provide equivalent levels of protection as those in your home jurisdiction.

EU and UK Data Subjects. Canada’s PIPEDA law has received a finding of “adequacy” from the European Union under Article 45 of the GDPR. However, if you are in the EEA or the UK, and we process your personal information in a jurisdiction that the European Commission or the UK has deemed to not provide an adequate level of data protection (a “third country”), such as the United States, we will implement measures to adequately protect your personal information, such as putting in place standard contractual clauses approved by the European Commission or the UK or another measure that has been approved by the EU Commission or the UK as offering adequate safeguards for the protection of personal information when transferred to a third country. You may request additional information about the safeguards we have in place by contacting us as set forth in the “Contact Us” section below.

Security and Retention

We have implemented safeguards that are intended to protect the personal information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee security.

Vidyard retains personal information only as long as necessary to serve the identified purposes for which it was collected, subject to legal requirements. You may also submit requests to delete and close your Vidyard account, as set forth in the “Privacy Rights and Choices” section below.

Privacy Rights and Choices

You have options when it comes to your account, content, and other personal information that Vidyard collects and processes. If you would like to submit a privacy request related to your personal information that Vidyard processes on behalf of one of our customers, you should contact that customer directly. If you require assistance in contacting one of our customers, you may contact our Data Privacy Office for support.

Unlink social media profile. Should you wish to unlink your Vidyard account from your social media profile, simply log into your account, select “Groups” and click “Integrations”. Select the specific Integration and click “Remove” next to the social media profile you would like to unlink.

Access, verify, correct, update or delete personal information. You can update certain information by logging into your account. You may also submit your request to our Privacy Request Center at preferences.vidyard.com . Vidyard shall respond and execute your request, subject to any contractual or legal restrictions.

Close your Vidyard account. If you wish to delete your account and stop doing business with Vidyard, please contact our customer service representative at success@vidyard.com . Please note that we may retain account data and content for a period of time after you close your account, such as where necessary to meet our legal and compliance obligations or protect or defend legal rights.

Opting out. You can opt out of certain processing activities by Vidyard, including:

  • Marketing emails: If you are subscribed to receive promotional and marketing emails from Vidyard and would like to opt-out, you can do so by (i) clicking ‘unsubscribe’ in any marketing email we send to you, (ii) emailing your opt-out request to vbot@vidyard.com , or calling us at 1-800-530-3878 (toll free). If you do opt out of promotional and marketing messages, Vidyard may still contact you regarding our business relationship with you.

Privacy laws in the European Union (EU), United Kingdom (UK) and California require that we provide specific information about our practices to individuals, including about the rights individuals have under these laws. GDPR Privacy Information

For the purposes of the GDPR and data protection laws in the EU and the UK, Buildscale Inc., d/b/a Vidyard, is the data controller of your personal information collected pursuant to this Policy. (With respect to any personal information that we collect on behalf of our customers pursuant to the Services, our respective customers are the controllers, and we are a processor.)

Rights under the GDPR. Individuals in the EU and the UK have the following rights with respect to their personal information:

  • Right of access: You can ask us to confirm whether we are processing your personal information, to provide you a copy of that personal information (along with certain other details.

  • Right to rectify (correct) personal information: You can ask us to rectify inaccurate or incomplete personal information. We may seek to verify the accuracy of the data before rectifying it.

  • Right of erasure: Subject to certain limitations you can ask us to erase your personal information, including when it is no longer needed for the purposes for which it was collected, where you have withdrawn your consent (where the data processing was based on consent), or when you have objected to our processing (and we no longer have a legal basis to process it). We are not required to comply with your erasure request under certain circumstances, such as where our processing is necessary to comply with a legal obligation or to establish, exercise or defend legal claims. If you are entitled to erasure, where possible, we will inform any third parties with whom we have shared your personal information of your erasure request, and if you ask us, we will also tell you with whom we have shared your personal information, so that you can contact them directly.

  • Right of restriction: You can ask us to restrict (i.e., keep but not use) your personal information under certain circumstances, such as when (i) you have contested its accuracy (and we are verifying whether it is accurate), (ii) our processing is unlawful, but you do not want it erased, (iii) we no longer need it for the purposes for which it was collected, but we need to maintain it to establish, exercise or defend legal claims, (iv) you have objected to our processing and verification of overriding grounds is pending. We can continue to use your personal information following a request for restriction, where (i) we have your consent, (ii) to establish, exercise or defend legal claims, or (iii) to protect the rights of another natural or legal person. If you are entitled to restriction, where possible, we will inform any third parties with whom we have shared your personal information of your erasure request, and if you ask us, we will also tell you with whom we have shared your personal information, so that you can contact them directly.

  • Right to object to our use of your personal information: You have the right to object to our processing of your personal information, and we will cease processing your personal information (i) where the processing is for direct marketing purposes, or (ii) we are relying on our legitimate interests as the legal basis for such processing, unless we can demonstrate that we have compelling legitimate interests which override your rights and freedoms.

  • Right to (data) portability: You can ask us to provide your personal information to you in a structured, commonly used, machine-readable format, or you can ask to have it ‘ported’ directly to another controller, but only where our processing is based on your consent and the processing is carried out by automated means.

  • Right to withdraw consent: If we rely on your consent (or explicit consent) as our legal basis for processing your personal information, you have the right to withdraw that consent at any time. If you have consented to the sharing of your content (including personal information) with third parties for training, improving and testing AI technologies and models, you can withdraw your consent through the “Privacy Settings” menu of your account, or by contacting us as set forth in the “Contact Us” section above (See our Content Sharing Policy for more information).

  • Right to lodge a complaint with your local supervisory authority: You have a right to lodge a complaint with your local supervisory authority if you have concerns about how we are processing your personal information. California Privacy Notice

This California Privacy Notice applies to the personal information that we collect about California residents. It provides additional information for residents of California about our collection, use and disclosure of their personal information, as well as their privacy rights, under California privacy laws, including the California Consumer Privacy Act (“CCPA”).

The table below identifies, generally, the categories of personal information (as defined by the CCPA) that we may collect, and have in the prior 12 months collected, about California residents, as well as the categories of third parties to whom we may disclose each category for a business or commercial purpose. Sales and Sharing. California privacy laws define a “sale” as disclosing, or making available to a third-party, personal information in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available personal information for purposes of targeted advertising. As defined by the CCPA, we may “sell” or “share” certain categories of personal information, including (a) Identifiers, Commercial Information, Location Data, Internet or Other Network Activity Information, and Inferences about you with advertising and social media networks and data analytics providers, in order to measure, improve and evaluate our marketing and advertising campaigns and reach users with targeted advertising (including across third party sites and services); and (b) Identifiers, Location Data, Internet or Other Network Activity Information, and Audio, Visual and Other Electronic Data with third party partners for their own analytics, marketing, and targeted advertising uses. We do not sell or share personal information, (including sensitive personal information) about individuals who we know are under sixteen (16) years old. Please note, that we do not knowingly sell or share any Sensitive Personal Information including Biometric Information. However, we do not control the content of customer videos and content; it is possible that customer videos or content may incidentally include Biometric Information or other Sensitive Personal Information, to the extent a customer has created content or videos that include such information.

Purposes and Means of Collection, Use, Disclosure, and Processing. As described in more detail in the “Purposes of Collection and Processing of Personal Information” section of our Policy, we may collect, use and otherwise process personal information for the following business or commercial purposes:

Sensitive Personal Information. Notwithstanding the purposes described above, we do not use or disclose Sensitive Personal Information beyond the purposes authorized by the CCPA. Accordingly, we only use and disclose such information as reasonably necessary (i) to perform our services requested by you, (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents, (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct, (iv) to verify or maintain the quality and safety of our services, (v) for compliance with our legal obligations, (vi) to our service providers who perform services on our behalf, and (vii) for purposes other than inferring characteristics about you.

CCPA Privacy Rights. Under the CCPA, California residents have the following rights (subject to certain limitations):

  • To know: to obtain information about what personal information we have collected about them, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about them.

  • To request deletion: to request that we delete their personal information, subject to certain exceptions.

  • To request correction: to request that we correct inaccurate personal information about them.

  • To opt out of sales and sharing: to opt-out of sales and sharing of their personal information.

  • To limit our use and disclosure of sensitive personal information: to limit certain uses or disclosures of sensitive personal information to those uses authorized by the CCPA; however, as noted above, we do not knowingly use or share sensitive personal information beyond these authorized uses.

We do not discriminate against consumers for exercising their CCPA rights.

Submitting CCPA Requests. California residents may exercise their CCPA privacy rights as set forth below. We will process your request based upon the personal information in our records that is linked or reasonably linkable to the information provided in your request. In some cases, we may request additional information in order to verify your request, or where necessary to process your request.

Requests for Access, Correction, Deletion. California residents may submit CCPA requests to know, correct, and delete their personal information maintained by us:

Please provide us with sufficient information so that we can identify your personal information in our records and process your request. We will take steps to verify your request, such as by (i) sending you an email confirmation link which you must click to confirm your request; and (ii) matching information provided by you, with the information we have in our records.

Requests to Opt Out. We provide several ways for you to opt out of sale and sharing:

  • Browser opt out: you can review and manage your preferences for cookies and tracking on our Websites through the cookie banner that appears on our Websites, where applicable to you. Note that if you come back to our website from a different device or use a different browser on the same device, you will need to manage your cookies settings for that browser and device as well.

  • Other “sales” and “sharing”: you can submit a request to opt out of sales and sharing (other than via your browser and cookies on our Websites), through our Privacy Request Center at preferences.vidyard.com . If you are a customer, you may also submit a request through the “Data and Privacy” menu in your Vidyard account settings. We will process your opt out request, based upon the information in our records that is linked or reasonably linkable to the personal information in your request.

Authorized Agents. Authorized agents may initiate a CCPA request on behalf of another California resident by emailing us at privacy@vidyard.com. Authorized agents may be required to provide proof of their authorization, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent (where permitted by the CCPA).

Rights Under California Shine the Light Law. Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), customers of businesses that provide products and services for personal or household purposes may be entitled to request and obtain, free of charge, information about the personal information (if any) that the business has shared with third parties for their own direct marketing use. Such requests may be made once per calendar year. However, as noted, our Services are intended for business customers only. You may submit a “Shine the Light” request to us by emailing privacy@vidyard.com and identifying your request as a “Shine the Light” request. However, we reserve the right to decline your request, if you are not entitled to make it under the “Shine the Light” law.
