6 section ""07 of title 3" United States %ode and section 30" of title 3 United States %ode it is herey ordered as follo1s8 Section "5 Pur9ose5 It is the 9olicy of the e:ecuti/e ranch to e 9rudent and financially res9onsile in the e:9enditure of funds from oth 9ulic and 9ri/ate sources5 In addition to the mana2ement of the direct e:9enditure of ta:9ayer dollars throu2h the ud2etin2 9rocessit is essential to mana2e the costs associated 1ith the 2o/ernmental im9osition of 9ri/ate e:9enditures re;uired to com9ly 1ith Federal re2ulations5 To1ard that end it is im9ortant that for e/ery one ne1 re2ulation issued at least t1o 9rior re2ulations e identified for elimination and that the cost of 9lanned re2ulations e 9rudently mana2ed and controlled throu2h a ud2etin2 9rocess5 Sec5 !5 Re2ulatory %a9 for Fiscal -ear !0"#5 4a6 Unless 9rohiited y la1 1hene/er an e:ecuti/e de9artment or a2ency 4a2ency6 9ulicly 9ro9oses for notice and comment or other1ise 9romul2ates a ne1 re2ulation it shall identify at least t1o e:istin2 re2ulations to ere9ealed5 46 For fiscal year !0"# 1hich is in 9ro2ress the heads of all a2encies are directed that the total incremental cost of all ne1 re2ulations includin2 re9ealed re2ulations to e finali<ed this year shall e no 2reater than <ero unless other1ise re;uired y la1 or consistent 1ith ad/ice 9ro/ided in 1ritin2 y the 'irector of the Office of =ana2ement and .ud2et 4'irector65 4c6 In furtherance of the re;uirement of susection 4a6 of this section any ne1 incremental costs associated 1ith ne1 re2ulations shall to the e:tent 9ermitted y la1 e offset y the elimination of e:istin2 costs associated 1ith at least t1o 9rior re2ulations5 ,ny a2ency eliminatin2 e:istin2 costs associated 1ith 9rior re2ulations under this susection shalldo so in accordance 1ith the ,dministrati/e Procedure ,ct and other a99licale la15 4d6 The 'irector shall 9ro/ide the heads of a2encies 1ith 2uidance on the im9lementationof this section5 Such 2uidance shall address amon2 other thin2s 9rocesses for standardi<in2 the measurement and estimation of re2ulatory costs> standards for determinin21hat ;ualifies as ne1 and offsettin2 re2ulations> standards for determinin2 the costs of e:istin2 re2ulations that are considered for elimination> 9rocesses for accountin2 for costs in
different fiscal years> methods to o/ersee the issuance of rules 1ith costs offset y sa/in2s atdifferent times or different a2encies> and emer2encies and other circumstances that mi2ht ?ustify indi/idual 1ai/ers of the re;uirements of this section5 The 'irector shall consider 9hasin2 in and u9datin2 these re;uirements5 Sec5 35 ,nnual Re2ulatory %ost Sumissions to the Office of =ana2ement and .ud2et

4a6 .e2innin2 1ith the Re2ulatory Plans 4re;uired under E:ecuti/e Order "!@AA of Se9temer 30 "3 as amended or any successor order6 for fiscal year !0"@ and for eachfiscal year thereafter the head of each a2ency shall identify for each re2ulation that increases incremental cost the offsettin2 re2ulations descried in section !4c6 of this order and 9ro/ide the a2encyBs est a99ro:imation of the total costs or sa/in2s associated 1ith each ne1 re2ulation or re9ealed re2ulation5 46 Each re2ulation a99ro/ed y the 'irector durin2 the Presidential ud2et 9rocess shalle included in the Unified Re2ulatory ,2enda re;uired under E:ecuti/e Order "!@AA as amended or any successor order5 4c6 Unless other1ise re;uired y la1 no re2ulation shall e issued y an a2ency if it 1as not included on the most recent /ersion or u9date of the 9ulished Unified Re2ulatory ,2enda as re;uired under E:ecuti/e Order "!@AA as amended or any successor order unless the issuance of such re2ulation 1as a99ro/ed in ad/ance in 1ritin2 y the 'irector5 4d6 'urin2 the Presidential ud2et 9rocess the 'irector shall identify to a2encies a total amount of incremental costs that 1ill e allo1ed for each a2ency in issuin2 ne1 re2ulations and re9ealin2 re2ulations for the ne:t fiscal year5 )o re2ulations e:ceedin2 the a2encyBs total incremental cost allo1ance 1ill e 9ermitted in that fiscal year unless re;uired y la1 or a99ro/ed in 1ritin2 y the 'irector5 The total incremental cost allo1ance may allo1 an increase or re;uire a reduction in total re2ulatory cost5 4e6 The 'irector shall 9ro/ide the heads of a2encies 1ith 2uidance on the im9lementationof the re;uirements in this section5 Sec5 C5 'efinition5 For 9ur9oses of this order the term Dre2ulationD or DruleD means an a2ency statement of 2eneral or 9articular a99licaility and future effect desi2ned to im9lement inter9ret or 9rescrie la1 or 9olicy or to descrie the 9rocedure or 9ractice re;uirements of an a2ency ut does not include8 4a6 re2ulations issued 1ith res9ect to a military national security or forei2n affairs function of the United States> 46 re2ulations related to a2ency or2ani<ation mana2ement or 9ersonnel> or 4c6 any other cate2ory of re2ulations e:em9ted y the 'irector5 Sec5 75 *eneral Pro/isions5 4a6 )othin2 in this order shall e construed to im9air or other1ise affect8 4i6 the authority 2ranted y la1 to an e:ecuti/e de9artment or a2ency or the head thereof> or 4ii6 the functions of the 'irector relatin2 to ud2etary administrati/e or le2islati/e 9ro9osals5
