Uncle spared jail for stealing from nephews' sick fund

A man who stole thousands of pounds raised for his three terminally ill nephews escaped jail today after a judge ruled he was only "borrowing" the money.
More than £8,000 raised for young brothers Callum, Connor and Jack Smith went missing from their grandparent's home in Leicester in October last year.
Their uncle, Anthony Smith, 27, pleaded guilty to theft at Leicester Crown Court but said he had only taken £2,000, leaving the rest behind.
Judge Peter Morrell ruled today that there was no evidence Smith had taken the remaining £6,000 and ordered him to repay the money stolen.
