PC freed in street assault case
A police constable found guilty of common assault after he was caught on film attacking a man today had his prison sentence quashed despite losing an appeal against his conviction.
Peter Empsall was convicted at Leeds Magistrates' Court last October after film footage showed him kicking and punching Christopher Wilson in a street in Wakefield.
He was jailed for two months but was released on bail pending an appeal.
Today, Judge Norman Jones QC, sitting with two magistrates at Leeds Crown Court, upheld Empsall's conviction but quashed his sentence.
He instead ordered him to carry out 200 hours' community service and told him to pay £2,500 costs.
