Getting down to business
Arming yourself with the basic facts of divorce law in the UK can help you feel in control of what is happening to you and help you to get the most
out of any settlement.
Helen Richardson, Family Law Partner at Berrymans Lace and Maver says: 'The
whole process may seem very complicated at first, so the best thing to do
is to seek expert advice . People very often don't realise what they are
entitled to financially and can come off a lot worse without guidance.
'At the end of the day, what you should be aiming to achieve is a sensible
agreement in an adult fashion.'
In order to obtain a divorce in England or Wales a couple needs to have
been married for at least one year. The petitioner also needs to be
domicile (habitually resident) in the country.
A divorce is granted on the basis that the marriage has irretrievably
broken down or that one of the partners is behaving so unreasonably that
they are impossible to live with.
