The negative margin is for p + ul, which assumes the p has a positive margin that needs cancelling. In VE - all content is wrapped in a <p> including content inside list items. These wrapper paragraphs have no margin.

I think maybe you misunderstood the phrase "not under active development". In this context, at least, it means that nobody is in the process of making any big changes to it; as one of the two main editors used for Wikimedia wikis (and many other wikis), it is considered stable, and is very well supported and well maintained.

@Madalina, @mszabo and I decided that we don't need to prioritize this (the ellipsis menu for topic headers on desktop) for the incident reporting system. It would be nice to have, but adding the support in DiscussionTools looks somewhat complicated and would probably best be done by a maintainer of DiscussionTools.
QA has been completed and the new code is functioning and displaying as expected (user will NOT get the error message "You are no longer logged out, so the action could not be completed.")...
Also this passes the Acceptance Criteria (Anonymous editor who fails an edit because of triggering a CAPTCHA and is then logged-in as a temp account will be able to save the edit after filling the CAPTCHA).

If the negative margins are an issue, we could potentially take on the suggestion here in T366389 to replace negative margins with a different solution to potentially kill 2 birds with 1 stone. but this code has been very tricky and fragile across all the different spacing possibilities
