Waivers
OIG has the authority to waive an individual's or entity's exclusion from participation in Federal health care programs.
When can a waiver be requested?
Waiver possibilities for exclusions under Sections 1128(a) of the Act
An individual or entity excluded under sections 1128(a)(1), (a)(3) or (a)(4) of the Act may be eligible for a waiver only when the excluded individual or entity is the sole community physician or the sole source of essential specialized services in a community AND the exclusion would impose a hardship on beneficiaries (as defined in section 1128A(i)(5) of the Act) of that program.
An individual or entity excluded under section 1128(a)(2) of the Act as a result of a conviction related to patient abuse or neglect is not eligible for a waiver. See 42 CFR 1001.1801(a)-(b).
Waiver possibilities for exclusions under Sections 1128(b) of the Act
For an individual or entity excluded under OIG's permissive exclusion authorities (section 1128(b) of the Act), a waiver may only be granted if OIG determines that imposition of the exclusion would not be in the public interest. See 42 CFR 1001.1801(c).
Who can request a waiver?
A waiver may only be requested by the administrator of a Federal health care program. Excluded individuals or entities may not request a waiver from OIG.
