The Department is providing you with updated information on this rule change process related to Chapters 9 and 13 that is based on SB25-130 , concerning providing emergency medical services, and SB25-152 concerning health-care practitioner identification. The on-line review and comment will be extended until February 15, 2026 due to the identification of the need for language that was not presented at the November and December meetings. The addition is indicated by highlighting in the updated documents available here.

Please see Chapter 9, lines 122-126 and Chapter 13, lines 156-160. For your added convenience, the additional text is as follows:

(G) In the event that a facility explains its treatment obligations and the risks to the patient, and the patient or patient’s representative refuses transfer, additional examination, and/or treatment for the emergency medical condition, the facility shall document the refusal in the patient's record and attempt to obtain the patient’s written informed refusal.

Please use this form if you wish to provide comments to the Division.

There are still multiple opportunities to comment on the draft rules. The next step in the official process will be a Request for Rulemaking at the Board of Health on March 18, 2026. There will not be public discussion of the draft rules on March 18, but there will be public comment allowed at the hearing, which is likely to be held on May 20, 2026, if the Board of Health grants our request. Details will follow in additional public notices.

You are invited to participate in the stakeholder process to review, reorganize, and update 6 CCR 1011-1, Chapter 15 - Dialysis Treatment Clinics.

The Department reviews its rules every five to seven years in accordance with Section 24-4-103.3, C.R.S. to assess their appropriateness and ensure they remain up-to-date with recent statutory and regulatory changes and developments in healthcare settings. The last substantive update to Chapter 15 was in 2014, and, during its last review, the Department identified several changes necessary to better reflect current practice, standards, and language in the dialysis setting.

Public meetings are currently planned for the second Wednesday of the month from February 2026 through June 2026 for a total of five meetings. All interested parties are invited to attend meetings either in-person at the Department or online via Zoom.

The first stakeholder meeting will be held on Wednesday, February 11, 2025, from 1:00 - 3:00 p.m.

The CDPHE HAI AR program provides quarterly National Healthcare Safety Network (NHSN) office hours. HAI Advisory Committee Meeting - Jan. 27, 2026 - Possible of removal of reportable healthcare-associated infections from the HAI Annual Report

We invite stakeholders to attend the HAI Advisory Committee Meeting from 2:00 - 4:00 p.m. on Monday, Jan. 27, 2026. During the meeting, the HAI Advisory Committee will discuss whether to remove the following conditions from the list of reportable conditions and from the HAI Annual Report:

Surgical site infections (SSIs) following outpatient colon surgeries in acute care hospitals
Central line-associated bloodstream infections in critical access hospitals
SSIs following surgeries in critical access hospitals:
inpatient hysterectomies,
outpatient hysterectomies,
inpatient breast surgeries,
outpatient breast surgeries,
outpatient colon surgeries, and
outpatient hip surgeries.

The HAI Advisory Committee is considering removal of these reportable conditions, because small numbers of procedures and data suppression rules contribute to tables empty of data in the HAI Annual Report; however, the Committee must also consider whether the low numbers of procedures and infections may be due to underreporting, as well as alternative quality measures.

XCEL Energy Announces Public Safety Power-Shutoff on Friday, Jan. 16 for Larimer and Weld Counties

Re: XCEL Energy Announces Public Safety Power-Shutoff (PSPS) on Friday, Jan. 16 for Parts of Larimer County, and parts of Weld County

Due to extreme wildfire risk and a Fire Weather Watch issued by the National Weather Service, Xcel Energy has issued notice of a power shutoff (Public Safety Power Shutoff or PSPS) on Friday, January 16, 2026, in parts of Larimer and Weld counties, from approximately 8:00 a.m. - 4:00 p.m. Unplanned outages may also occur due to damage from extreme winds.

Xcel crews will be staged at the Fort Collins service center on Friday to patrol and restore lines as quickly as possible, once it is safe to do so. For damaged lines, it may take up to several days for power to be restored from planned or unplanned outages.

Please check the up-to-date Xcel Electric Outage Map to see if your address is impacted (Even if you are not in a PSPS zone, high winds can cause other outages). You can monitor the event on the Public Safety Power Shutoff Event Update.

Placing an emphasis on delivering care even in the face of power outages must be a priority to protect residents, clients, patients and staff from harm.

Preparation for residential providers

Have emergency plans and arrangements in place if you cannot provide generator power and need to evacuate medically compromised residents.

Other suggestions:

Consider your DME supply and potential needs.
Consult your facility’s emergency plan.
Notify engineering and facility staff as early as possible of additional power needs.
Review evacuation plans and prepare staff in case of power outages, and make sure your transportation is in good working order.
Monitor indoor temperatures. Increase the frequency of patient observations, especially those at high risk.
If you lose heat and are in a high-rise building, prepare to move individuals from lower floors to higher floors (remember, heat rises).
Conserve supplies, such as ice and fuel, based on anticipated or current shortages.
Keep medications cool. Place medications that require refrigeration in an ice chest or cooler packed with ice, cooling bricks, or cold packs. Use a thermometer to monitor medication temperatures to ensure they're safe to use. Avoid freezing medication by making sure it does not directly touch the ice.
Plan and consider options and plans for access to food and meals during the power outage.

Preparation for home health/home care agencies and in-home hospice providers with clients at home:

Agencies are responsible for having individualized emergency plans for their clients, based on their individual needs.
Encourage your clients who have durable medical equipment to have extra batteries and/or a car charger available. Keeping extra concentrator batteries fully charged will give your clients oxygen for longer if you lose power. If possible, keep enough fully-charged batteries to last a couple of days.
Arrange with clients’ oxygen suppliers for back-up emergency supply that does not require electricity, such as oxygen tanks and cylinders. Make sure your clients know how to set up and use their back up emergency oxygen supply.
If you have clients that rely on several different types of electrical assistive devices, he/she/they may want to look into purchasing a generator. Temporary use generators can be purchased at most hardware and department stores (such as Lowe’s, Home Depot, Sears, and similar stores).

Every year, the Colorado Department of Public Health and Environment (CDPHE) Healthcare-Associated Infections and Antimicrobial Resistance (HAI/AR) Program publishes the HAI Annual Report, which contains HAI data from facilities across the state. In 2025, we launched an HAI Dashboard alongside the annual report to give consumers an interactive data display.

We are now evaluating how healthcare facilities utilize the HAI Annual Report and HAI Dashboard to identify opportunities for making them more widely available and effective. We ask that one or more administrators, infection preventionists, patient care providers, quality improvement professionals, or people in other relevant roles complete this brief 5-10 minute survey. The first part of the survey asks questions about the written HAI Annual Report. The second part of the survey asks questions about the HAI Dashboard.

CDC - Advancing Hemovigilance to Identify Transfusion-Transmitted Infections

The CDPHE Healthcare-Associated Infections and Antimicrobial Resistance (HAI/AR) Program encourages healthcare facilities to enroll in the National Healthcare Safety Network (NHSN) hemovigilance module in 2026. The module is designed to track infrequent (a handful of events in the U.S. every 1-2 years) but serious transfusion-transmitted infections (TTI) nationwide and facilitate a rapid public health response. All U.S. healthcare facilities where blood components and manufactured blood products are transfused are eligible to report.

CDC is updating the hemovigilance module of the Biovigilance Component of NHSN in early 2026 to quickly and systematically identify emerging pathogens that can be transmitted through blood transfusions. The new module (version 3.0) is substantially streamlined relative to the current version. Participating healthcare facilities will have their laboratory system flag pathogens of interest.* The flag will trigger the hospital epidemiologist or infection preventionist to review the patient’s transfusion history in the prior 30 days and send an alert to CDC via NHSN if positive. CDC will work with the CDPHE HAI/AR Program to investigate TTIs in Colorado.

Eligible healthcare facilities can enroll in the new hemovigilance module and complete the Annual Facility Survey in January 2026. Reporting can begin at the end of March 2026 (estimated March 19). In the meantime, CDC will announce and host dedicated office hours for enrolled facilities.

TTIs can be severe and geographically widespread, but they are under-identified. Enrolling in the NHSN hemovigilance module 3.0 will help keep patients and the public safe. Enrollment is voluntary.

HFEMSD is hosting a rules revision roundtable discussion for 6 CCR 1011-3 - Standards for Community Integrated Health Care Service Agencies, related to the licensing of CIHCS Agencies. This rule revision is in response to the Sunset Report from the Colorado Department of Regulatory Agencies (DORA) and the accompanying bill extending the program, Senate Bill 25-192. All interested parties and the public are invited and welcome to attend.

The next meeting will be held on Tuesday, January 20, 2026, from 1:00 - 3:30 p.m., and subsequently on the third Tuesday of each month until May 2026. All meetings can be attended remotely via Zoom. This fourth meeting will be held in a hybrid format. Attendees can participate either in-person at the CDPHE campus or remotely via Zoom.

The Department is excited to announce that it will be convening a stakeholder process to review, reorganize, and update 6 CCR 1011-1, Chapter 15 - Dialysis Treatment Clinics.

The Department reviews its rules every five to seven years in accordance with Section 24-4-103.3, C.R.S. to assess their appropriateness and ensure they remain up-to-date with recent statutory and regulatory changes and developments in healthcare settings. During its last review, the Department identified several changes necessary to better reflect current practice, standards, and language in the dialysis setting.

The first stakeholder meeting will be held on Wednesday, February 11, 2025, from 1:00 - 3:00 p.m.

Subject: Cancellation of Stakeholder Meeting and Updated Documents regarding 6 CCR 1011-1, Chapter 9 - Community Clinics and Chapter 13 - Freestanding Emergency Departments

The department is providing you with updated information on this rule change process:

The meeting scheduled for January 14, 2026, is cancelled. Review of the updated regulations was completed in the first two meetings. This review covered SB25-130, concerning providing emergency medical services, and SB25-152 concerning health-care practitioner identification. Please note that any changes since the previous version presented at the November and December meetings are indicated by yellow highlighting.
The current versions of the draft rules are available here and include edits from the previous meeting.
There are still multiple opportunities to comment on the draft rules. Please use this form if you wish to provide comments to the Department. Those comments are due no later than February 1, 2026.
The next step in the official process will be a Request for Hearing at the Board of Health on March 18, 2026. There will not be public discussion of the draft rules on March 18, but there will be public comment allowed at the hearing, which is likely to be held on May 20, 2026. Details will follow in additional public notices.
