I replaced the licence PD-Polish with the licence PD-scan|PD-old-70|deathyear=1945. Will it be okay?
The file (a scan) comes from the online version of the book by Adam Przybylski (1896-1945), Wojna Polska 1918 ― 1921, (Warszawa: Wojskowy Instytut Naukowo - Wydawniczy, 1930), which is in the collection of the digital library Polona.pl. Świadczy o tym źródło: https://polona.pl/item/wojna-polska-1918-1921,ODk3NzQwMjQ/8/#info:metadata, gdzie jest informacja "prawa do utworu: Domena Publiczna". Znajduje się też wielki znak Domeny Publicznej. O tym, że jest to PD świadczy również data śmierci autora 1945. Przyznam, że jak dotąd nie spotkałam się na Commons ze zgłoszeniem pliku w Domenie Publicznej, ponieważ najklarowniejsza dla Commons licencja, wobec której nie ma się żadnych wątpliwości. There are several political parties that call themselves "Partido Socialista" and it is unknown which group this logo belongs to and how it came about that somebody unknown licensed this logo under a Creative Commons license. - @Yuraily Lic: I created the armour evolution compilation; I understand it's only up for deletion because the first picture on the left of Jango Fett (taken from File:Mandalorians at Star Wars Celebration VI 2012.jpg) may be in violation of Commons:DW? Yet the Category:Cosplay of Jango Fett does allow some photos that have passed an official review. The discussion above also shows that you cancelled the deletion of File:SWC4 - Pair of Fetts (512823048).jpg for this reason. I'm prepared to change my compilation with a different photo of a Jango Fett cosplayer, as long as I can get a guarantee that one won't be deleted. Would File:Wait, the Jedis are with Jango Fett? - Presumably you are referring to File:Woolas 2010 election leaflet.jpg and File:Oldham East and Saddleworth 2011 by-election campaign materials (fair use).jpg. These are non-free fair use images and hosted on English Wikipedia, and are not on Commons. Fair use files are not allowed on Commons, see Commons:Fair use. Something not having a copyright notice is insufficient, we need clear evidence of a free licence. It may be possible to upload this to English (or Welsh) Wikipedia as non-free file with a fair use rationale, see Wikipedia:Non-free content and Wikipedia:Non-free use rationale guideline. - Your reason for the deletion request is not understandable. The diagram is not without content. Could you please elaborate why this diagram is not acceptable for Commons? As far as I can see this is a language adaptation of File:Vasectomy diagram-en.svg without proper attribution, i.e. proper attribution could be added. This is a calligraphy of Spring Morning (春晓) poem by Tang dynasty poet Meng Haoran. The text of the poem is of course in public domain, but the author of the calligraphy is Lin Sanzhi, who created it in 1978 and died in 1989 (see here). The remaining (undeleted) photos are those that are a bit more sophisticated: I couldn't find the photos elsewhere or that the user claimed them to come from NASA. Some of the NASA-claimed photos are clearly not from NASA (aerial photos published elsewhere), but I don't have the energy to check the remaining photos one-by-one. It's safe to safe that the user's history of misrepresenting the copyright status for the photos they upload is enough to place all the photos they uploaded in doubt. - Because the uploader does not give the impression of a trustable one. Please have a look at File:Girl posing nude at spot.JPG; it is only 35 KB and of course w/o camera EXIF. How can one think that the above mentioned two pics, one black and white from 1963 and the other from "supposedly" 1962 but well in colours and uploaded in 2015, 50+ years after the "click". Thank you for commenting on this image, and the opportunity to participate. How is the investigation progressing? The negative I have uploaded should prove the own work issue. The other questions are dealt with at the Piccadilly Circus image site; I know you have discussed the matter with Tobias-something. There are obviously similar issues with most, if not all my images, so please delete this image, as well as the others I have requested deleted for the same reasons. - Comment @Srittau: Is this negative a match for the image you deleted following Commons:Deletion requests/File:Tropical night girl.jpg? If so, then this whole matter is a wrap, since posession of the negative practically proves authorship, given the context. The likely sock account User:JaneMenice remains a problem, but maybe their user page gallery is nothing more than a clumsy attempt at promotion, and there’s nothing wrong with that (unless we start cracking down on Commons’ photographers who self promote in their user pages…). - Category:Queen of Sidney (ship, 1960) contains exactly two images.
- We don't seem to have Category:Sidney Class ferry. So, I don't think you can assert Category:Sidney Class ferry contains superior images of a Sidney class ferry in silhouette.
- About a decade ago a contributor nominated an image I had uploaded of an excursion vessel, on the Danube, claiming (1) we had enough images of this excursion vessel; (2) this particular image was marred because it showed tourists.
I responded that I was not aware of any policy or guideline that specified a maximum number of in scope images we should host. Ronald Reagan, when fighting environmental activists, claimed, "If you have seen one Giant Redwood you have seen them all." We host multiple thousands of images of the Statue of Liberty, the Eiffel Tower and lots of other topics. What we do when we have lots of in scope images is start creating subcategories, to keep the number of images in each category to a manageable number.
That the image showed tourists was not a defect, it was a desirable feature. Tourists ride excursion vessels, so we should keep images that show tourists. FWIW, when I looked into it, that particular excursion vessel was not just any excursion vessel, it was a heritage vessel, making the presence of tourists in that image even more desirable.
I bring up this example to encourage Ponderosapine210 to adopt a more open-minded inclusive attitude towards image retention. - Keep. The Stormtrooper costume is Star Wars' version of body armor, which is a useful article of clothing. Designs which serve a utilitarian purpose are not eligible for copyright — taken as a whole, the Stormtrooper outfit is basically just a white-colored suit of armor. It is possible that the detailed designs of the helmet/etc could be copyrightable per the separability test; it's impossible to know for sure without a judge's ruling. However, those possibly-copyrighted details are not very prominent in most of these photos, and would appear to be de minimis use. I'd definitely advocate for adding {{Costume}} to all of these, but deletion seems too extreme. –IagoQnsi (talk) 23:14, 6 August 2020 (UTC)

Files in Category:Cosplay of Stormtroopers, a first part
[edit]I believe we do have some issues in hosting these files, the nominated files originate from the US. They constitute a probable copyvio. My reasoning:
- per en:Lucasfilm Ltd v Ainsworth, in 2006 Lucasfilms got a summary judgement confirming Stormtrooper designs to be copyrighted in the US ("Accordingly, the United States District Court for the Central District of California gave summary judgement in favour of Lucasfilm, awarding USD $20 million in compensation.") Carl explained in Special:PermaLink/1119996773#Star Wars Stormtooper cosplays that a summary judgement is only used for "undisputed facts" - so we have to assume that it's an undisputed fact that these costume elements are copyrighted.
- I think that people using these costumes aren't similar to a bottle with a label, so a photo of a Stormtrooper cosplayer is necessarily a derivative of these sculptural armour pieces. It's not similar enough to the summary of Ets-Hokin v. Skyy Spirits, Inc. presented in COM:DM US.
- I don't see any saving grace: no COM:FOP US, COM:DM not applicable as the images are described and categorized as Stormtrooper imagery.
- COM:COSTUME also provides us with several arguments for a deletion. The images all encompasses sculptural masks, the cosplay is definitively not incidental, the characters are copyrighted as demonstrated above. And Mike Godwin likely gets trumped by a sworn judge in the case Lucasfilm Ltd v. Shepperton Design Studios Limited et al that is cited as ref in en:Lucasfilm Ltd v Ainsworth.

- It's not an affirmation of anything, and overrides nothing. If you don't defend a case, it's usually an automatic ruling against you. It also had nothing to do with cosplay (people wearing licensed costumes) but rather the actual manufacture of costumes. It was also a bigger trademark issue than a copyright issue, though there is a copyright aspect as well (the case also included TIE fighter pilot helmets). The U.S. Copyright Office has stated that masks are typically not utilitarian, so can be considered as artwork. So, for copyright reasons, the stormtrooper masks are the main issue to me -- they would most likely be considered sculpture. So photos focusing on the masks, probably an issue. The rest, likely not. That would be true if that court case never existed, as well. The case was not about photos of cosplay -- it was the actual manufacture of unlicensed costumes, which of course included the helmets and perhaps some other separable elements of the costumes. Der Fotograf ist Orgelbauer und wurde aus beruflichen Gründen zu Servicearbeiten an die Orgel bestellt. Diese Kirche ist speziell kein öffentlicher Raum und somit sind Aufnahmen aus dem Inneren des Gebäudes nicht erlaubt. Der Herr "IP-Löschanträger" ist in diesem Fall befugt für die Kirchengemeinde zu sprechen, da diese den "Löschanträger" darum dringend heute telefonisch gebeten hat.
- Der Löschantrag sollte noch einmal vom Uploader und nicht per IP gestellt werden. Rein rechtlich geht es hierbei aber mehr um das Rechtsverhältnis Fotograf / Kirchengemeinde (also das Hausrecht), das uns eigentlich nicht interessieren muss. --Reinhard Kraasch (talk) 19:57, 10 November 2020 (UTC)

Disagree. The image has been reproduced accurately and not in a misleading context, I would also state that if you delete this image then you'll need to delete all photos of former Assembly Members (please don't, there are far more imporatnt tasks on wiki to take care of!) I also think it's fairly clear that the photo and biographical details of an elected representative on an institutions webpage are available for use, and would have been used by the media at the time.
