- Delete the image on the MoD website has the attribution "Drummer Lee Rigby [Picture: H Szymanski]" which clearly suggests that it is not released under the generic Government Open Licence. Keep Based on this MoD page archive. The MoD site states "All content is available under the Open Government Licence, except where otherwise stated", and as can be seen on the page where two versions of the photo are used, there is no statement that leads us to presume that OGL does not apply. I recognize that the MoD have since changed the page, but if the MoD or the photographer wish to have this photograph deleted, they should put the case by email or issue a valid take-down on the basis that the MoD made a mistake in publishing the image. - Comment As stated above, the photographer and the MoD are in a dispute over this. Mail news article The image was uploaded to Commons in good faith by someone who assumed it was OGL, and all of the worldwide media outlets that have used the image have assumed this as well. I nominated the image for speedy deletion as it could easily be uploaded again after the dispute is resolved. There is no reason to believe that the MoD messages or the Mail article are wrong, but for the purists the request should come from the photographer directly.--Ianmacm (talk) 10:39, 5 August 2015 (UTC)

The source is correct, but there's no proof that the owner of the picture released it under a free license. The website doesn't indicate an author, but it does say, "© Unique World Records Limited 2015, All Right Reserved". I think the uploader should contact the website after reading COM:OTRS. This looks like professional work to me. It's on several sites, such as this one [6]. I think the uploader must prove ownership or get permission from the photographer using COM:OTRS. The official Facebook page has an enlarged cropped version of this image, from an earlier date [7]. The full version might be somewhere on the Internet or in a printed source. Keep.Comment. I couldn't find evidence of copyvio. It's not found elsewhere with an internet search, except for the cropped version linked above. It's a large file, probably the full uncropped version, with EXIF, where the date matches the period of the museum's 2011 exposition. The user likely had access to the original. I would rather assume good faith and keep it, unless evidence to the contrary is found. It could be useful though if the user clarified if he/she was the photographer or if he/she is someone else from the museum and authorized to manage the copyright of this photograph. - Comment Thanks for your comments Asclepias and Dontreader. Both Images "Haute Couture à voix basses" and the exhibition "Collection Privée " belong to the Musée suisse de la Mode. As an institution, the MuMode works with professional photographers who also have it the copyright as well as the Musée suisse de la Mode. What are your recommendations to not delete these photos?
- Bonjour, On tentera de clarifier les faits pertinents et, selon les faits, de voir comment il serait possible de s'y prendre pour valider et conserver les images.
- La première étape de clarification des faits serait d'établir si vous êtes vous-même, personnellement, le photographe de la photographie File:Musée suisse de la Mode.jpg, comme le laisse actuellement entendre le fait que vous avez inscrit votre pseudonyme d'utilisateur dans la section «auteur» de la description de la photographie, et si vous en êtes aussi, personnellement, le titulaire légal des droits d'auteur, comme le laisse entendre actuellement votre utilisation du modèle «self» pour offrir la licence libre. D'après votre commentaire ci-dessus, dans lequel vous référez aux photographes à la troisième personne ainsi qu'au musée, j'aurais l'impression que la réponse est non. S'il y a eu erreur, cela peut avoir été une erreur de débutant, mais néanmoins il s'agit d'une information importante, avec des conséquences juridiques, et si l'information inscrite est fausse il faut la corriger. Donc, si vous n'êtes pas le photographe, il faut que vous retiriez votre pseudonyme du champ «auteur» et qu'à cet endroit vous inscriviez plutôt le nom du photographe (sauf dans l'hypothèse exceptionnelle où le photographe lui-même aurait donné son accord explicite pour que son nom ne soit pas mentionné). Enlever aussi la mention «own work» du champ source et y indiquer la vraie source, par exemple si c'est un fichier pris sur le site du musée ou si c'est un fichier qui vous a été transmis directement par le musée ou par le photographe, etc. Et si vous n'êtes pas personnellement le titulaire des droits d'auteur, il faut que vous enleviez le mot «self» dans le code du modèle de licence, puis que vous fassiez valider la licence par le titulaire des droits.
- La deuxième étape serait de s'assurer précisément de qui détient quels droits d'auteur sur les photographies. Cela se détermine essentiellement par ce qui est écrit dans les contrats entre les photographes et le musée. Les photographes ont-ils cédé au musée seulement les droits d'utiliser les photos dans les publications et activités du musée ? Ou les photographes ont-ils, dans les contrats, clairement cédé au musée des droits qui peuvent raisonnablement s'interpréter comme étant suffisants pour permettre au musée de décider unilatéralement d'offrir des licences libres, qui permettent au public de réutiliser les photographies pour n'importe quelles fins et dans tous les pays ? Si ce n'est pas suffisamment clair, il faudrait alors plutôt présumer que les photographes se sont réservés à eux-mêmes tous les droits qu'ils n'ont pas explicitement cédés au musée. On voit malheureusement trop souvent des cas d'institutions qui croient à tort avoir obtenu tous les droits sur des photographies, alors qu'après vérification du contrat ou après vérification auprès du photographe, on constate qu'en réalité l'institution n'avait obtenu qu'un droit d'utilisation limité. Il est possible que les contrats avec différents photographes pour différentes photographies ne soient pas tous identiques. Évidemment, dans chaque cas, il faut se référer spécifiquement au contrat pertinent à la photographie en cause. Vous n'avez pas précisé si vous avez un lien avec le musée. Si c'est le cas, les démarches seront probablement plus faciles.
- En troisième étape, lorsqu'on saura qui, des photographes ou du musée, détient vraiment les droits suffisants pour pouvoir offrir des licences libres, cela déterminera qui il vous faut contacter pour demander la validation des licences libres. Si c'est le musée qui est titulaire de ces droits, il faudra contacter le musée. Si ce sont les photographes qui sont titulaires de ces droits, il faudra contacter les photographes. Il s'agit de demander au véritable titulaire des droits s'il accepte d'offrir sous licence libre les photographies et il faut obtenir de ce titulaire des droits une réponse claire d'offre de licence libre. Vous trouverez sur la page Commons:OTRS/fr toutes les informations nécessaires sur la façon de faire une telle demande et sur ce qui doit être déclaré par le titulaire des droits et confirmé par lui à Wikimedia. Lorsque Wikimedia aura reçu cette confirmation par le titulaire des droits, elle sera archivée par Wikimedia et le fichier sera marqué comme ayant été validé. Si Wikimedia ne reçoit pas de confirmation par le titulaire des droits, le fichier devra être supprimé.

As Asclepias said (I think - I don't understand French well), there are many cases in which photographers and organizations have informal agreements in which both the photographer and the organization claim to have the copyright (ownership) of the pictures. However, according to copyright law, only the photographer continues to own the picture (and the copyright) unless there is a formal written transfer of ownership. If the Musée Suisse de la Mode did not go through the process of a formal written transfer of ownership from the photographers to the Musée Suisse de la Mode then the photographers are the only copyright holders. Since they are professional photographers, can you find out their names, please? Maybe they have their own photography websites, and then you would just need them to send a formal declaration of consent to Commons in which they agree to release the pictures under a free license. I can help you with that if you know the photographers. Or you could ask the museum to give you their names. If this research takes a long time, don't worry because even if the files are deleted, they can be restored later by an administrator when the declarations of consent are received and processed by an OTRS agent. - CommentThe Musée suisse de la Mode has a formal written agreement with Fabian Sbarro for the "Haute Couture à voix basse", which can be sent. Regarding the exhibition's picture "Collection Privée", the photographer Fabrice Sbarro worked voluntarily for the museum, so there wasn't a formal contract about the ownership. However, the MuMode is trying to reach Fabrice Sbarro in order to provide his agreement. In the meantime, the source about "Collection Privée" was modified, as recommended by Asclepias. Sorry for the mistakes and we are trying to address the situation. Petit musée

I appreciate that the uploader is honest. The problem is that screenshots from movies belong to the movie producers. This very weird image can be found on this page if you scroll down a bit [10]. - Delete. The uploader honestly wrote that the author and copyright owner is Bertrand Pichène, who is a professional photographer [13]. Same thing for this other file: File:Ensemble Canticum Novum.jpg, an uncropped version of which can be found on the website of the musical group [14]. The uploader is likely someone affiliated with the musical group and thought that they could license the photographs. They don't seem to be attributed to the uploader. (I was hoping you would find it, because for some reason sometimes my browser doesn't work well when scrolling down very long facebook pages. it actually froze this time and I had to restart it. Anyway, I finally got there.) There's one thing I notice now. Although the photo was posted on facebook in 2013 and the Commons version File:Майдан 2013.jpg was uploaded in 2016, the facebook version looks smaller and a little more cropped on three sides. Also, the file File:Майдан 2013.jpg on Commons has EXIF from the camera, to the contrary of the two other KVPU files uploaded by the uploader, File:КВПУ.jpg and File:Конфедерація Вільних профспілок .jpg, which do not have EXIFs from the cameras. In other contexts, it could give some credibility to the file. - N.B.: The position of the photographer wouldn't be a reason for deletion, even if the position had been unusual. And in the photo File:КВПУ.jpg, it is not unusual. When taking photographs at events, one sometimes climbs on whatever is there and reasonably appropriate for the purpose, steps, bench, block... In the photo File:Майдан 2013.jpg, the photographer could have had permission to be in front of the barrier, or stepped there for a moment, or be behind another barrier, etc. -- Asclepias (talk) 20:33, 30 July 2016 (UTC)

Unclear copyright status, considering film posters (+ 1 still) related/produced to/by "NextMovie Studios", uploaded since 05.2016, needing COM:OTRS-confirmation. Especialy the spam File:Rio 2016 Olympics Games - NextMovie Studio.jpg ("This poster will officially announce that August 5, 2016 you will see on the site (...) - I noticed that the original statement was signed by the "The RLJ Companies" and questioned whether they had the authority to do that, as there was an indication that Melissa Golden was the copyright holder. The response was that the company contracted with Melissa Golden, and agreed that the photo credit should remain with Melissa Golden.
- This is all a perfectly routine set of circumstances. Time in Crimea cannot be UTC+3 _OR _ UTC+2 in winter period! Status of peninsula can be moot, but not time! It NOT depends on opinions "whose" Crimea is (Russia or Ukraine). - Keep. This isn't Wikipedia, files don't have to be factually accurate. The title is clear on what the image shows, so it isn't misleading. You can oppose its addition to any Wikipedia if you like. And in response to your comments, Crimean people can observe whatever time zone they like. There are lots of Ukrainians still in Crimea. There is certainly a dispute over what time zone the peninsula legally observes, as there is a dispute over what country it is legally part of! - A file on commons doesn't actually need to be used on any Wikipedia. That is not the sole purpose of Commons. And yes 16% is actually a lot. I also doubt every ethnic Russian wants to be a Russian citizen. Those in the Baltics certainly don't. Edit warring is not acceptable but at least on Wikipedia, there can be intellectual discussion on the map, and a consensus can be formed based on the weight of the argument. On Commons, there is no such procedure because you are allowed to upload alternative versions, even if they are POV. Can you actually cite Commons policy which would support deleting this file? If deleting it, and probably in any case, we must restore all usages of it to File:Time zones of Europe.svg. - The date needs to be the date of the image, the author is not the uploader, if not known use {{unknown|author}} and the license needs to be correct for the image. Ok, first of all thanks for your help. I changed the date to 1894 and the author to "unknown" but now i am stuck. How do i find out which is the "correct" license? - ping Herb Econis Great! To answer your question, new accounts are referred to a page abbreviated as COM:L... which itself leads to many places... For me personally, the easiest page to understand about licenses is COM:HIRTLE which is a table showing the various licenses and when they would be applied. There is no information about the publication of this image but fortunately it is so old that it would fall into the top one, if it were never published; if it had been it would be in the second one down. There is also Commons:International copyright quick reference guide which goes country by country, again this image is 2 years older than the limit. So if it were first published in UK, it would most likely get {{PD-old-70-1923}}. Do you have access to a larger image? This one is really small. Ellin Beltz (talk) 17:14, 4 August 2016 (UTC)
Thanks again! I went through the Hirtle list and think you are right. I changed the license and at last i choose the category transport. Hopefully this helps to keep this picture. I do have a slightly larger image, and that is the one I uploaded. The size we do have here is the size used on the page i uploaded it for. I dont know how to overwrite the small image. Another help would be appreciated. Rhonda asked me to add her photo to her Wikipedia page, so I have just been trying to do it and attempting various ways to figure out how to do it correctly and appropriately. I have been trying to read articles and understand what's necessary, and my understanding was finding it online would help provide a correct source / reference. - COM:EVID "In all cases the uploader must provide appropriate evidence to demonstrate either that the file is in the public domain or that the copyright owner has released it under a suitable licence. Typically that requires at least that the source of the file be specified,[1] along with the original source where the file is a derivative work. Also, the creator or copyright owner should be identified, if known or reasonably ascertainable. If there is any question, evidence may need to be supplied that the copyright owner has indeed released the file under the given licence."
- COM:TOO. I realize that you are hung up on this guideline but it doesn't trump source & license.

- COM:PS/FT: this is nearly correct, but, should not be better to convert the logo to SVG instead of nominating a file currently in use? I can (take the logo found in the official website, provide the proper source and then vectorize using Inkscape), but we should discus the TOO first (see bellow)
- COM:EVID: The PDF may be taken from somewhere I agree, but it is tagged as Own work, so, there is 50% of possibility that the uploader vectorized the logo and exported to PDF (instead of SVG). Also, other admins already mentioned that {{PD-textlogo}} files does not require a source in order to keep, and this is why most of the (your) TOO-related DRs has been resolved as Kept (see bellow), so, who is right? (and I personally don't trust in an admin who does not apply the Copyright laws properly, and is unable to answer TOO-related questions).
- COM:TOO: So, You didn't answered why the logo is bellow or above the Threshold of originality (a legal statement in several Copyright Laws, not just a guideline; unlike other admins, you still ignoring, or at least, ommiting that in every TOO-related DRs for years). If you still thinking I have personal problem with you, let Me remember this important part of the Copyright Laws (bellow the TOO, no copyvio, so, you can't claiming copyvio and/or requiring sources or "EVID" if the logo is actually not protected under the Copyright Law; this is just like the Freedom of panorama).
- Since the file is currently in use (therefore in scope):
- Therefore, the only valid reason for deletion is Copyvio (since the file is currently in use, and again, the Threshold of originality is the only relevant element of copyright here). This model had the First flight in 1949 and the very limited production, I do not think more than ten examples, as well as the aircraft registration I-MACH, see this database, suggesting that the photo is of one of the aircraft certificating in Italy in date 01/05/1950 and sold in the France market in the 1950s (subsequent registration F-OAHN; F-BDHN).
