Most of these have nonsense descriptions with no obvious educational value, and if we assume that collectively all the pictures are depicting members of the band "Five Harmony", there's no evidence that the band nor its photographer agent agreed to release these files.

After today identifying around 15 uploads as copyvio (grabbed from 3 different Panoramio-accounts, blogs etc.) it´s difficult to believe that these remaining files would be own work: IMHO untrusted user uploading a bunch of copyrighted material (small/inconsistent resolutions, missing exif) so these ones (per COM:PRP) can't be believed either. Files mostly coming from http://www.panoramio.com/user/2811031 (CC BY-'NC-ND 3.0), a lot of mysteriously edited/watermarked images (e.g.: File:TehsilPirmahalz 9.JPG + File:TehsilPirmahalz 11.jpg), apparently all related to apnapirmahal.com, screenshotted website (e.g. File:Ptbt2009 8.jpg + File:Ptbt2009 1.JPG), etc.

Invalid use of {{PD-Art}}: not a 2D artwork. Stefan4 (talk) 00:38, 18 February 2014 (UTC)[reply]

Keep. Looks flat enough to me (plus it's one of the most exceptionally beautiful things I've ever seen - new to me, thanks for that). 209.99.57.90 11:28, 18 February 2014 (UTC)[reply]
Looks less flat than a coin and a coin is not flat enough. --Stefan4 (talk) 14:40, 18 February 2014 (UTC)[reply]
Keep: vexatious and non-constructive and (frankly) suspect in its motivations.
In the first place I've uploaded a better image of this beautiful piece from its museum page and credited the photographer Karl Siegfried Mühlensiep. I've made a conscientious search in Google and Flickr, and I'm pretty sure this is the only image available on the internet.I expect it appears in Goldschmiedekunst in Ulm published by the Ulm Museum and illustrated with images by Mühlensiep amongst others.
There's no question of course that this image is in either Mühlensiep's or Ulm Museum's copyright, depending on the nature of their professional relationship, and since neither have placed it in the public domain that I can see, it really shouldn't be in Commons. Nevertheless the abundance of images of other works by Michel Erhart suggest that his pieces are readily photographed and there's no reason to suppose that a free photograph might not one day appear. Presently a high-quality image is provided by Ulm Museum, and while that has no bearing on the public domain issue, it does suggest that Ulm Museum is not mightily protective of it or Mühlensiep's copyright. We're not talking Vincent's Three Sunflowers (F543) here, which has scarcely seen the light of day since it was purchased by the French couturier Jacques Doucet in 1912 (and not at all since a brief exhibition at the Cleveland in 1948), to all our very great loss as it is described as stunningly fresh and in pristine condition.
Presently this image appears on the user pages of two users, both of them noted and prodigious contributors to Wikipedia's coverage of the visual arts (and neither incidentally associated with ... erm how to put this? ... the flowering of high quality images downloaded from the likes of the National Gallery and National Portrait Gallery of London recently placed on Commons). It's difficult to understand why they've been singled out in this matter. It does rather suggest simple spite, doesn't it?
I look at dozens of Commons images every day and every day I notice violations of Commons policy. What's the figure for properly licensed Flickr images, for example? Somewhere round 5% I believe?
What we need here is a template questioning whether the image is free, encouraging the uploading of a documented free image, and providing a link for photographers and their estates to contest the image if they feel their copyright has been violated. That really ought to satifsy our most ardent coin-tossers. Fantes 007 (talk) 11:37, 23 February 2014 (UTC)[reply]
Keep Flat enough, a few hundred years old and per Fantes. Deleting this would be shameful. Ceoil (talk) 11:41, 23 February 2014 (UTC)[reply]

Still worth persevering with, some of us have had sex and everything. In most countries, all paintings, sculpture, architecture, text, and other creative works have copyrights which last for 70 years after the death of the creator. An image of a work that is still under copyright is a derivative work, and infringes on the copyright so that we cannot usually keep the image on Commons. In some countries, there is a special exception to the copyright law which allows such images under certain circumstances. We call that exception freedom of panorama (FOP). Unfortunately there is no applicable FOP exception in the Netherlands. .     Jim . . . . (Jameslwoodward) (talk to me) 17:23, 18 February 2014 (UTC)[reply]

No Creative Commons license according to original source [16] --Einsamer Schütze (talk) 14:46, 18 February 2014 (UTC)[reply]

Keep: I have already explained that the license was creative commons at the time of the upload and has been changed since then. This is why the license was confirmed by the bot at the time of the upload (otherwise the bot would not have confirmed the license!). I am not responsible for the flickr user changing his license but it was creative commons at the time of the upload. Additionally, the user put it as creative commons at the time with the express purpose that it be uploaded on wikicommons. I have emails confirming this. But even without this indication, I believe that the license at the time of the upload is what matters.Iry-Hor (talk) 09:57, 23 February 2014 (UTC)[reply]

"Free use of this picture is allowed" does not mean that it is published under a free license - see COM:LICENSING: Commons only allows traceable real free licenses 178.2.55.100 16:08, 18 February 2014 (UTC)[reply]

Frankly, I don't know what it means. This upload dates from 2006, ancient history, and I will not claim at all that what was good for the goose in 2006 is good for the gander in 2014. I suggest someone OTRSey find out if images from this source in fact are on a free license. No skin off my nose if they are not. I am not interested in putting any time into checking this out or defending the upload, as I am sure, Polish Wikimedians have this topic sussed out by now, and only need to make their knowledge explicit. Someone in Poland could easily get in touch with the government and sort this out, if they have not already. Delete away. :) --Mareklug talk 02:36, 19 February 2014 (UTC)[reply]

Keep – Just put other_field={{vector version available}} on the images, and be done with it. Nobody (= not me) has the nerve to check if the GIFs and JPGs could be optimized versions for their resolution; even for the PNGs I'm not aware of a tool to check if it's just SVG rendered as PNG, or optimized. –Be..anyone (talk) 06:06, 18 February 2014 (UTC)[reply]

This file was initially tagged by JuTa as no license. The uploader added PD-old later. Well, the sculptor de:Ferdinand Pettrich died in 1872. So the sculptur is in th public domain. But we would need a license for the foto as well from the fotografer. JuTa 20:28, 18 February 2014 (UTC)[reply]

  •  KeepIt's true that the uploader did not give nearly enough information. However, the user did note that the photograph came from the Smithsonian and Gene Young (the photographer listed in the EXIF) is a Smithsonian photographer (which would mean it's PD as a US government work). The sculpture is a current registered U.S. copyright [VA0000203798] of A. Thomas Schomberg, and is the main subject of these photographs. Freedom of Panorama only applies to architecture in the United States.

The Haz talk 17:46, 18 February 2014 (UTC)[reply]

  • Keep the first one, delete the rest. I think an argument for De minimus can be made for File:9.26.06RockyStatueByLuigiNovi1.jpg, since I intentionally made the museum in the background as significant part of the image as the statue in the foreground. I don't think the same can be said for the rest (which includes the other one I took on the list, File:9.26.06RockyStatueByLuigiNovi3.jpg).
In terms of De minimis, I disagree for the image in question. This essentially implies that the object in question is not important to, and incidentally part of, the photograph. However, this would seem the opposite. My reasoning:
  1. The description makes a point that this image is used to illustrate the sculpture.
  2. The file is in the "Rocky statue" category.
  3. The file name is "RockyStatue".
  4. The sculpture itself is in sharper focus than any other part of the image.
  5. If you remove the sculpture from the image, it would drastically alter the image.
Also, please don't remove the deletion template. While I like the photo (and live down the road from the sculpture), this is an issue of legality. Commons licensing means (barring any trademark issues), just as an example, someone could create a t-shirt from the right half of your image and sell it without the sculptor's permission. However, I'm confident that it would not be legal in the U.S. The Haz talk 21:20, 18 February 2014 (UTC)[reply]

Although it says that the photograph was taken in 1918, there is no evidence of this, and it looks like a creation of a more recent camera model. Stefan4 (talk) 00:43, 18 February 2014 (UTC)[reply]

Keep - "looks like" not good enough. I've included the image in Category:Death masks. Ayesha23 (talk) 20:38, 18 February 2014 (UTC)[reply]
Then where is the evidence that the photograph was taken in 1918? And why does it look like a photo taken using a modern camera, if it was taken in 1918? --Stefan4 (talk) 22:22, 18 February 2014 (UTC)[reply]
And where's your evidence it wasn't? The photograph could easily have been taken in 1918 (it might be a more recent print). Knowing how tight the Wien is, I can well imagine permissions were never granted after 1918. Fantes 007 (talk) 10:40, 19 February 2014 (UTC)[reply]
It is the uploader's responsibility to provide evidence that it was taken in 1918 and that both the photographer and the mask maker have been dead for at least 70 years. The uploader claims that one of them (unspecified who) is called Moriz Schroth, but the uploader failed to specify a year of death. --Stefan4 (talk) 22:27, 19 February 2014 (UTC)[reply]
Moriz Schroth was a celebrated creator of death masks of his day. Of course his efforts have fallen into obscurity, though some of his moulding are still illustrated. The uploader's mistake here was not to claim he took the photo himself. No one gives a toss. Move on (wash the sheets, do it in a park). Fantes 007 (talk) 04:25, 20 February 2014 (UTC)[reply]

Still in artist's copyright. Check with User:Stefan4. Coat of Many Colours (talk) 01:14, 18 February 2014 (UTC)[reply]

So how does that work for US PD where the servers are? 209.99.57.90 11:20, 18 February 2014 (UTC)[reply]
A very good question on which our linguistically challenged template-wielding Swedish wonder-barn is strangely mute. User:Coat of Many Colours is quite right to raise it. To set it in context for curious readers, works by the British sculptors Henry Moore and Barbara Hepworth are still in their estates' copyright. But Freedom of Panorama means that in the UK you can publish in the UK photographs of their work in public places. But that dispensation doesn't of course extend to the US. Its own laws on Freedom of Panorama are much more restrictive and in particular do not extend to works of art. I've applied one of Wikipedia's ubiquitous (that's quite a hard word meaning something you see everywhere Stefan - the unspoken nuance FYI is that one would rather like to see less of them HTH) templates {{Not-free-US-FOP}}. I've no doubt in my mind that this file, and all like it, shouldn't be on Commons. American publishers shouldn't be publishing images of works by either Henry Moore or Barbara Hepworth without the permission of their estates, whether public or otherwise, and the same should apply to Commons. 64.9.146.117 08:12, 19 February 2014 (UTC)[reply]

As long as the surface is not noticeably curved or tattered/broken, and the original work is old enough to have entered the public domain, it is considered a faithful reproduction of the original with no original contribution.
There's a huge Category:Textiles. They've always been regarded as two dimensional. Mary Ebbets Hunt work was all completed before 1923, so this is comfortably PD in the US. There's another image of a work by Ebbets Hunt (not the same - look for example at the decoration above the central face) at File:Chilkat robe by Mary Ebbetts Hunt (Anisalaga), Tlingit people, Honolulu Museum of Art, 4183.JPG and another not quite so fine Chilkat blanket at File:Chilkat Blanket (8032220562).jpg as well as several other related images in Category:Chilkat weaving. The one marked for deletion is an exceptionally fine example offered for sale in Paris recently, though I don't think it reached its reserve. It would be great pity to delete this beautiful image, which must be amongst Commons' finest. 31.6.45.47 07:36, 18 February 2014 (UTC)[reply]
This has plenty of 3D effects. Compare with {{Non-free frame revdel}}. --Stefan4 (talk) 14:43, 18 February 2014 (UTC)[reply]
No, you're just moving the goalposts here. You could say that about any of these images. The fact is you thought it was a sculpture. Textiles as 2-D works of art are an accepted category at Commons. This was a faithful representation published in a sale catalogue, uploaded as it happens by a noted authority in the field. It's not a creative image and the whole thing is accepted and settled for Commons and has been for ages. Your intervention here is not constructive. 31.6.45.63 19:24, 18 February 2014 (UTC)[reply]
No, I have never thought that this is a sculpture - I have only said that this has a shape similar to that of a sculpture, and that is all which matters. You can see lots of light effects - and that is all what matters, meaning that permission from the photographer is required. --Stefan4 (talk) 22:10, 18 February 2014 (UTC)[reply]
"No, I didn't think it was a sculpture" is the correct use of tenses (your use implies you have known the work a long time), indicating just how elementary your grasp of English really is and doubtlessly explaining your reluctance to enter into any meaningful dialogue with your fellows here that you interact with. It also explains why you were able to put up that ridiculous reference to "Photograph of an old sculpture ..." so flat out contradicted a few sentence above it for textiles, simply lacking the scanning skills in English to pick up on it. You didn't say it "was similar to the shape of a sculpture", you're inventing that, rather you referred your reader to guidance about sculptures in an authoritative and final way. You plainly thought it was a sculpture. The relevant ordinance is the one about textiles, and that ordinance qualifies its remark about "texture" with "essentially", a nuanced position I suggest you are nevertheless unable to assimilate because of your inadequate grasp of English. It goes on to give criteria for textiles to be considered PD and these say nothing enough light effects. The fact is this image is a faithful representation with no original contribution and your intervention here really isn't constructive. On your principles most of the images in the "Textiles" category would have to be removed. 31.6.45.198 02:57, 19 February 2014 (UTC)[reply]
Keep The textile bears no similarity to a sculpture but has a very close similarity to a tapestry for which COM:ART says Commons official policy is that {{PD-Art}} applies.[24] The fact that the fabric could be screwed up into a ball and photographed in 3D doesn't mean that this is the case here. If a photographer screwed up the canvas of the Mona Lisa, a photo he then took would, in my view, attract copyright. Thincat (talk) 10:33, 21 February 2014 (UTC)[reply]
