TICKET CONTRACT

THE FOLLOWING TERMS & CONDITIONS GOVERN YOUR BOOKING AND CRUISE TICKET:

(A) THE CRUISE TICKET CONTRACT BETWEEN YOU AND ROYAL CARIBBEAN CRUISES LTD. d/b/a Royal Caribbean International. (WHICH MAY BE FOUND HERE) (THE “RCL CONTRACT”) NOTE THAT THE APPROPRIATE RCL CONTRACT IS BASED ON YOUR COUNTRY OF RESIDENCE.

AND

(B) SUPPLEMENTAL TERMS, CONDITIONS AND LIMITATIONS AS BETWEEN YOU AND UMCruises International Ltd., HEREINAFTER REFERRED TO AS UMCruises. (WHICH MAY BE FOUND HERE)

THE RCL CONTRACT AND THE UMC T&C (COLLECTIVELY, THE “CONTRACT”) CONTAIN IMPORTANT LIMITATIONS ON YOUR RIGHTS AND CONSTITUTE A LEGALLY BINDING CONTRACT BETWEEN YOU AND ROYAL CARIBBEAN CRUISES LTD. AND BETWEEN YOU AND UMCruises. PLEASE READ ALL OF THE CONTRACT CAREFULLY. NOTE THAT IN THE EVENT OF A CONFLICT BETWEEN THE RCL CONTRACT AND THE UMC T&C, THE UMC T&C SHALL PREVAIL.

The RCL CONTRACT and the UMC T&C are subject to change at any time without notice.

All references to “UMCruises” shall be understood to include UMCruises International Ltd., Ultimate Music Cruises Inc., UMCruises UK LLP, 70000tons.com, addpax.com and any entity wholly owned by any of the aforementioned entities or affiliated through ownership with the owners of any of the aforementioned entities. All references to “Royal Caribbean” shall be understood to mean Royal Caribbean Cruises Ltd. d/b/a Royal Caribbean International. For purposes hereof, each reference to a Royal Caribbean “promotional partner” shall include UMCruises. All references to the “Cruise” or to “70000TONS OF METAL®” (or any variation of the event name) shall be understood to refer to the 70000TONS OF METAL® cruise aboard a Royal Caribbean vessel. All references to “Guest” shall have the same meaning as “Passenger” for purposes of this Contract and shall include each person listed on a Booking Confirmation or Cruise Ticket and each person, other than UMCruises personnel, as well as Royal Caribbean personnel, who embarks on the Cruise or attends any Cruise or Cruise related event, whether or not listed on a Booking Confirmation or Cruise Ticket. All terms shall be considered gender neutral and pronouns shall refer to the masculine and feminine as context requires.

Each Guest’s reservation for the 70000TONS OF METAL® Cruise, acceptance and/or use of the Cruise Ticket, embarkation on the Cruise, and attendance at any Cruise event constitute the acceptance of and agreement to this Contract. By purchasing or accepting the Cruise Ticket for the 70000TONS OF METAL® Cruise, you represent to and for the benefit of UMCruises and Royal Caribbean that you are authorized by all Guests named in your reservation group, including each minor, if any, to accept and agree on behalf of each such Guest to be bound by the Contract. This Contract is not transferable and you may not sell or assign it. It is valid only on the vessel and for the voyage and event indicated. This Contract may not be modified except in writing signed by UMCruises. The terms, conditions and limitations herein shall apply to any and all disputes between you and UMCruises and Royal Caribbean, regardless whether arising aboard the vessel or in any other place, location or any mode of transportation whatsoever. All rights, defenses, disclaimers and limitations of liability set forth herein shall inure to the benefit of UMCruises, Royal Caribbean, and all concessionaires, independent contractors or other providers of any services or facilities in connection with or incident to the Guest’s cruise, as well as any of their affiliated or related companies, parents, subsidiaries, successors, assigns or fictitiously named entities; and all suppliers, shipbuilders, component part manufacturers; and their owners, operators, managers, charterers, agents, pilots, officers, crew, employees and vessels. Neither UMCruises, nor any of its employees have any authority to change, modify, alter or suspend any of the provisions of the RCL Contract, which shall govern the relationship between Guest and Royal Caribbean exclusively.

UMCruises International Ltd. (UMCruises) SUPPLEMENTAL TERMS AND CONDITIONS

(the “UMC T&C” as defined above)

1. Nature of the Cruise

The 70000TONS OF METAL® Cruise is a live concert event cruise featuring multiple headline musicians/bands at multiple venues aboard a cruise ship. Nothing contained herein is intended to be, nor shall it be construed as a right or guarantee to specifically attend any particular concert on any particular date to be performed by any particular artist. UMCruises and Guest agree that Guest is purchasing passage on board a specific vessel during a specific period of time. Included in such purchase price, but ancillary thereto, is an entertainment package pursuant to which several artists (principally musical acts) will perform at a time, or times, during the Cruise, which times will be announced prior to sailing and/or during the Cruise. While every effort is made by UMCruises to avoid conflicting events and performances, UMCruises cannot guarantee that any Guest will be able to attend every performance aboard the Cruise. The access to each venue aboard the Cruise is on a first come, first served basis and needs to be restricted according to the maximum spectator numbers for each venue according to the operator of the vessel. It is also anticipated that individual musicians will attend publicity and promotional events during the Cruise while on board to provide Guests an opportunity to meet the musicians in person. However, UMCruises can make no guarantee that any guest will in fact be able to meet any of the musicians in person during the Cruise or during any shore excursion.

2. Lead Passenger

The Passenger that places the reservation for 70000TONS OF METAL® is the “Lead Passenger” and is the “owner” of the reservation. All changes, transfers or cancellations may be made by the Lead Passenger only.

3. Pricing

UMCruises reserves the right to increase published prices without notice. In the event of an increase, the Guest has the option of accepting the increased fare or canceling the reservation without penalty. Payment for the Cruise shall be made in United States Dollars (USD).
The parties agree that the consideration for the entertainment portion of the Cruise including performance by all musicians on board during the Cruise shall be the sum of USD 200.00. The remaining consideration paid by each Guest for the Cruise shall be allocated to the ship passage portion including stateroom and meals. The individual making the reservation for the 70000TONS OF METAL® Cruise is considered the “Lead Passenger” in whose name the reservation is held. The consideration for the cruise shall be deemed to be earned when paid and is not refundable.

4. Payments

All payments for the Cruise shall be made in United States Dollars (USD) only.

Payments may be made on the following terms. Depending on the date of booking, the Guest may be able to choose to pay in installments as follows:

A) Pay In Full At Booking (5% Discount)

1. For bookings until September 22, 2025:

Reservations that are paid in full at the time of booking will receive a Discount of 5% on the Official Ticket Price (The discount does not apply to the Taxes, Fees and Surcharge Portion of the Grand Total Ticket Price).

2. Bookings after December 22, 2025, will not receive any discount and must be paid in full.

 

B) Installment Plans:

1. For all bookings on or prior to September 22, 2025:

The Guest may choose to pay in 5 installments. The Guest pays 20% of the Grand Total Ticket Price at the time of booking and then 4 additional monthly installments of 20% of the Grand Total Ticket Price on the same day of each following month until fully paid.

2. For all bookings from September 23, 2025, through October 22, 2025:

The Guest may choose to pay in 4 installments. The Guest pays 25% of the Grand Total Ticket Price at the time of booking and then 3 additional monthly installments of 25% of the Grand Total Ticket Price on the same day of each following month until fully paid.

3. For all bookings from October 23, 2025, through November 22, 2025:

The Guest may choose to pay in 3 installments. The Guest pays 33.3% of the Grand Total Ticket Price at the time of booking and then 2 additional monthly installments of 33.3% of the Grand Total Ticket Price on the same day of each following month until fully paid.

4. For all bookings from November 23, 2025, through December 22, 2025:

The Guest may choose to pay in 2 installments. The Guest pays 50% of the Grand Total Ticket Price at the time of booking and then the remaining additional monthly installment of 50% of the Grand Total Ticket Price on the same day of the following month.

 

C) General Payment Terms.

Should the Guest’s initial payment not meet the minimum payment due at the time of reservation, the Guest will have 48 hours in which to bring their account into good standing or risk cancellation.

Installment payments that are not received by the dates indicated in the Guest’s Booking Confirmation are subject to a Late Fee of USD 50.00 per overdue Passenger.

Any payment not received within 2 days after the scheduled date will be charged automatically to the Lead Passenger of the booking.

Installment payments not made or collected within 5 days of the due date will risk cancellation of the booking. Cancellation terms will apply.

Under no circumstances will any Passengers be permitted to board the Cruise if the booking is not paid in full (including any late fees) and (if paid by method other than credit or debit card, received in cleared funds by 70000TONS OF METAL®) at least 48 hours prior to the sailing time of the Cruise.

All payments for the cruise shall be made in United States Dollars (USD) only. 70000TONS OF METAL® STRONGLY RECOMMENDS (but does not require) that each guest purchases Travel Insurance for the cruise.

5. Discounts

All and any discounts apply to the Cruise Fare (Official Ticket Price) only and not to any Taxes, Fees or Surcharge Portion of the Grand Total Ticket Price.

6. Taxes and Fees

In addition to the combined Cruise Fare and Entertainment Fees, UMCruises will collect USD 537.00 per Passenger for Taxes, Pre-Paid Gratuities, Port Charges and Fees, including, without limitation, a Booking
Fee. The Taxes and Fees portion must be paid for the full occupancy of the booking whether the full occupancy of the booking is used by Guests or left vacant.

7. Single Ticket Surcharge

A Surcharge of USD 100.00 per Passenger applies to Single Tickets in shared cabins.

8. Cruise Price Change

Royal Caribbean reserves the right to change, whether via an increase or decrease, any published rates, including cruise rates, without prior notice. Royal Caribbean reserves the right to impose on any existing booking or new bookings (whether paid in full or not) a supplement for fuel or other matters without prior notice as provided in our Passenger Ticket Contract. In addition, Royal Caribbean reserves the right to pass through any third party imposed fuel or other surcharges, also without prior notice, The guest will remain liable for any applicable taxes, fees or surcharges that may be assessed by any governmental or quasi-governmental agencies.

9. Cancellation

UMCruises STRONGLY RECOMMENDS (but does not require) that each Guest purchases Travel Insurance for the Cruise. Because of the nature and uniqueness of the 70000TONS OF METAL® Cruise, there is a strict cancellation policy.

All changes, transfers or cancellations may be made by the Lead Passenger of the booking only. No partial refunds will be made for individual Passengers. A private cabin booking can only be canceled completely for all Passengers in a booking. Alternatively, you can change Guests names or transfer your Booking to other persons as outlined in paragraphs 10 and 11 (Changes of Additional Passengers & Lead Passenger Transfers) below.

The cancellation policy is as follows:

If you cancel your cruise, you may request a full refund of your payments less an Administrative Fee of USD 100.00 per Passenger if you notify us in writing until October 30, 2025. Please note that only the paid Ticket Price, Taxes and Fees, and Single Traveler Surcharge (if applicable) may be refunded. Lead Passenger Change fees, Name Change Fees, Transfer Fees, Late Fees, or any other Administrative Fees are not refundable. Consult the chart below to determine the cancellation charges applicable after October 30, 2025.
Note: No refunds will be made if the Guest does not show up for their cruise or if the Guest interrupts or cancels their vacation once it has begun.

If the guest booked their vacation through a Travel Agent, please contact the Travel Agent for full details of applicable cancellation policies.

After December 30, 2025 No refund

UMCruises STRONGLY RECOMMENDS that all Guests purchase Travel Insurance. Guests that have purchased Travel Insurance and need to cancel for a covered condition may be able to make a claim with the insurance carrier to recover any lost payments.

10. Changes Of Additional Passengers

The Terms and Conditions defined in this paragraph supersede Royal Caribbean’s policies.

For bookings made up and until October 30, 2025, the Lead Passenger, in whose name the reservation is held, may change and/or add the name of any accompanying Passenger in the same cabin without charge.

Any reservation change made after October 30, 2025, is subject to the following administrative fees before the change is effected:

Guest changes or unknown guest additions after October 30, 2025, up and until December 30, 2025 – USD 100.00 Guest Change Fee per Passenger.

Guest changes or unknown guest additions after December 30, 2025 – USD 300.00 Guest Change Fee per Passenger.

For bookings made after October 30, 2025, the Lead Passenger, in whose name the reservation is held, may add the name of any accompanying Passenger in the same cabin without charge within 48 hours of booking. Guest changes or unknown guest additions made after 48 hours of booking will be subject to the fee schedule above.

11. Lead Passenger Transfers

A reservation for the cruise is valid only for the person(s) named within as Guests and cannot be transferred without UMCruises’ written consent. With written consent, you may transfer your Lead Passenger status to another party with a USD 300.00 Transfer Fee charged to the reservation. UMCruises will not consent to a Lead Passenger transfer during any pre-sale period or after an event sell-out when a waiting list exists. No Lead Passenger transfers will be accepted after December 30, 2025. For Single Ticket reservations the Guest may transfer their Lead Passenger status to another party of the same gender. UMCruises will not consent to a Single Ticket Lead Passenger transfer to another party of a different gender. Lead Passenger Transfers after any pre-sale period will invalidate any pre-sales discount granted for early booking.

The Lead Passenger and each Guest are STRONGLY RECOMMENDED to consider Travel Insurance to protect their trip. In lieu of cancellation, the Lead Passenger may request that his or her reservation be transferred to another person subject to the written consent of UMCruises and payment of the above referenced Transfer Fee.

12. Occupancy Changes, Upgrades and Downgrades

The Lead Passenger of a reservation may, upon written request and subject to availability, change the occupancy and/or upgrade and/or downgrade a reservation for 70000TONS OF METAL® subject to a USD 300.00 Booking Change Fee.
Changing the occupancy and/or upgrading and/or downgrading a reservation will not incur a USD 300.00 Booking Change Fee so long as:

  • The new reservation is in the same or a higher Booking Category as the original reservation, AND
  • The Per Passenger Ticket Price of the new reservation is higher than the per Passenger ticket price of the original reservation.

The upgraded booking may be subject to the 5% Pay in Full Discount if the original booking is already paid in full and the upgrade amount is paid within 48 hours of the upgrade.

Note: Any additional Discount (such as an early booking discount) will not apply to upgrade pricing if the request is made after Public Sales has begun.

13. Acceptance and Agreement of the RCL Contract

By making the reservation for the 70000TONS OF METAL® Cruise or by accepting and/or using the RCL Contract by the persons named thereon as Guests, and/or embarking on the Cruise and attending any Cruise-related events, the Lead Passenger and each Guest on the same reservation, acknowledges he or she has read, understands and agrees to be bound by each and every term, condition and provision of the RCL Contract and agrees to be bound thereby. Each Guest further agrees that, pursuant to the provisions of the RCL Contract, UMCruises, as charterer of the vessel, is included within the term “Carrier” in the RCL Contract and that UMCruises shall be entitled to the benefit of all rights, terms, conditions, and limitations granted Royal Caribbean thereunder as a charterer of the vessel as though UMCruises were specifically named therein.

14. Cancellation of the Cruise

Royal Caribbean has reserved, in the RCL Contract, the right to cancel the Cruise, and by extension the Ticket Contract at the port of embarkation or at any time during the voyage. If the Cruise is canceled completely prior to embarkation, each Guest shall receive a refund of his or her passage fare paid. If the Cruise is canceled during the voyage, each Guest shall receive a refund of a proportionate part of his or her passage fare paid. UMCruises shall have no further liability for damages or compensation of any kind.

15. Breach or Cancellation by Performing Artist

UMCruises has entered into an agreement with each performing artist on 70000TONS OF METAL® to be present on board the Cruise and to perform in accordance with terms specified therein. However, neither UMCruises nor Royal Caribbean shall be liable or responsible for failure of any artist or musician to appear on board or to perform under its agreement. Further, neither UMCruises nor Royal Caribbean shall be liable or responsible for any loss, damage, cost, or expense of any kind to any Guest or any other person or entity in the event that such performance is prevented or such loss, damage, cost, or expense is caused by or results directly or indirectly from any act of God, war, fire, collision, directions of underwriters, arrest, order or restraint by any government agency or official acting under color of authority, acts of terrorism, labor disturbances or disputes, civil commotion, weather conditions and considerations of the safety of the vessel (for which the Master shall be the sole judge), breakdowns of or damage to the vessel’s hull or machinery, requisition of the vessel by governmental authority, illness, death of a family member or other cause or circumstance beyond UMCruises’ reasonable control. In the event of any failure of contracted artists to perform during the cruise, UMCruises, in its sole discretion, may engage a replacement artist or artists, or may change, postpone or terminate all or any part of the Cruise or the entertainment program or change the program or itinerary. In such case, UMCruises shall have no liability to any Guest for any loss, damage, cost or expense whatsoever by reason of such change. In any other case including without limitation any breach of contract or failure to perform by any artist or musician, Guest and UMCruises acknowledge that Guest’s actual losses arising from such breach, cancellation or termination would be difficult if not impossible to calculate at the time of entry into this Agreement. A number of factors contribute to these uncertainties including without limitation the fact that Guest has embarked on a cruise and other substitute entertainment will be provided for Guest’s enjoyment and the difficulty of arranging substitute entertainment. Therefore, Guest agrees that the remedies described herein (substitution for any particular artist or musician or partial refund in the event of cancellation) represent fair compensation in the nature of liquidated damages to the exclusion of all other damages payable by UMCruises or Royal Caribbean, whether direct or indirect, proximate or incidental or consequential, for such modification, cancellation or termination of the Cruise by UMCruises. If the Cruise is canceled as the result of any material breach or gross negligence of UMCruises or of a contracted artist or musician, Guest shall be entitled to the sum of USD 100.00 representing a pro-rated amount of the entertainment portion of the consideration paid by Guest. No Guest shall be entitled to recover any incidental or consequential losses or damages sustained by him or her. Each Guest agrees this remedy shall be his or her exclusive remedy.

16. Public Performance

UMCruises has the exclusive right to include photographic, video and other visual portrayals of Passenger in any pictorial medium of any nature whatsoever for the purpose of trade, advertising, sales, publicity or otherwise, without compensation to Passenger, and all rights, title and interest therein (including all worldwide copyrights therein) shall be UMCruises sole property, free from any claims by Passenger or any person deriving any rights or interest from Passenger.

17. Age Restrictions

Guests are required to be twenty-one (21) years old (on embarkation day) to travel in their own cabin. Guests under the age of twenty-one (21) must be accompanied in the same cabin by an individual twenty-one (21) years or older. The adult twenty-one (21) years or older does NOT have to be a Parent or Legal Guardian.

The exceptions to this policy are:

  • Guests under the age of twenty-one (21) traveling with a parent or guardian in an accompanying cabin.
  • Married minor couple: The booking must be documented that the couple is married. The couple must have proof of marriage at embarkation or they will be denied boarding without the benefit of a refund.
  • Domestic Partners/Same-Sex Union minor couple: The booking must be documented that the couple are legal Domestic Partners/Same-Sex Union. The couple must have legal proof of partnership/union at embarkation or they will be denied boarding without the benefit of a refund.
  • Active Duty Members of the United States or Canadian military. The Passenger must have proof of active duty military status at embarkation or will be denied boarding without the benefit of a refund.

Guest ages will be verified at embarkation. Guests not conforming to this policy will be denied boarding and assessed a 100% cancellation penalty. No exceptions will be made at embarkation.

For Passengers that will be under the age of eighteen (18) years old (on embarkation day) and will NOT be traveling with their Parent or Legal Guardian with the same Last Name, a Notarized Letter Of Permission signed by their Parent or Legal Guardian MUST be present at the time of boarding, along with proper travel documentation. Guest ages will be verified at embarkation. Guests not conforming to this policy will be denied boarding and assessed a 100% cancellation penalty. No exceptions will be made at embarkation.
Infants must be at least six (6) months old as of the first day of the cruise. Guest ages will be verified at embarkation. Please be aware that guests traveling with a young infant that does not meet the infant policy will be denied boarding. No refunds or other compensation shall be due to anyone as a result of the denial of boarding to an underage infant or other accompanying guests.

18. Use of Photos, Videos, or Recordings

Guest hereby grants to UMCruises (and its assignees and licensees) the exclusive right throughout the universe and in perpetuity to include photographic, video, audio and other visual or audio portrayals of Passenger taken during or in connection with the Cruise or Cruise Tour (including any images, likenesses or voices) in any medium of any nature whatsoever (including the right to edit, combine with other materials or create any type of derivative thereof) for the purpose of trade, advertising, sales, publicity, promotional, training or otherwise, without compensation to the Guest. Such grant shall include the unrestricted right to copy, revise, distribute, display and sell photographs, images, films, tapes, drawings or recordings in any type of media (including but not limited to the Internet). Guest hereby agrees that all rights, title and interest therein (including all worldwide copyrights therein) shall be UMCruises’ sole property, free from any claims by Passenger or any person deriving any rights or interest from Passenger.
Guest hereby agrees that any recording (whether audio or video or otherwise) or photograph of Guest, other guests, crew or third parties onboard the Vessel or depicting the Vessel, its design, equipment or otherwise shall not be used for any commercial purpose, in any media broadcast or for any other nonprivate use without the express written consent of UMCruises. UMCruises shall be entitled to take any reasonable measure to enforce this provision.

19. Zero Tolerance Policy

UMCruises has a zero-tolerance policy regarding the use, possession, purchase or distribution of illegal controlled substances. Any violation of this policy will result in disembarkation from the vessel as well as the individuals being turned over to the local law enforcement officials for appropriate legal action. In such cases UMCruises and Royal Caribbean shall not be liable for any refund or other compensation or damages.

20. Governing Law and Forum

It is agreed by and between each Guest and UMCruises that the UMC T&C shall be governed by the law of the Commonwealth of the Bahamas. The exclusive jurisdiction and venue for all disputes and matters whatsoever arising under, in connection with or incident to the UMC T&C or to the 70000TONS OF METAL® Cruise, including any dispute or matter arising out of or related to Guest’s travel to the vessel involving UMCruises, shall be litigated in the courts in and for Nassau, New Providence Island, Bahamas, to the exclusion of the courts of any other province, county, state or country, and each Guest expressly submits to the jurisdiction of the courts in and for Nassau, New Providence Island, Bahamas, for such purpose.
